New laws on “rogue” bailiff behaviour will ensure a fair and effective enforcement system in England and Wales, according to the justice minister. Addressing local authorities and bailiff companies at the Civil Enforcement Association conference in London yesterday (29 January), justice minister Lord Faulks spoke of the major reforms to the rules for bailiffs which will take effect in April. The aim of the reforms is to ban bailiffs from using “heavy-handed behaviour” while ensuring they can still collect debts fairly. The changes detailed include stopping bailiffs from entering homes when only children are present and banning bailiffs from visiting debtors at night, so they will only be allowed to enter a property between 6am and 9pm. Prior to being granted a warrant, bailiffs must justify to the court the likely means of entry, the amount of force required and how the premises will be left in a secure state afterwards.....Read more hereTags: None

New rules for bailiffs are due to come into force on 6 April following a consultation by the Ministry of Justice (MoJ). The bailiff reforms, which come under the Tribunals, Courts and Enforcement Act 2007, include a new fee structure intended to bring an end to excessive and multiple charges. Under the rules, bailiffs are banned from visiting debtors at night and will only be allowed to enter a property between 6am and 9pm, while bailiffs will be unable to enter homes where only children are present.
