one dirty trick dvla tried and almost got me to settle was in the waiting room she produced a photo copy of the log book filled in by a new owner and she said if you filled it in and sent it back how has this person got hold of it my girlfriend was addament she sent it i was addament i filled it in so took a moment to think and said will see you in the court room well i let her do her worst then asked her why she only had photo copy and not the original and why she hadnt copyed pages three and four she replyed that it was because they were irrelavent so i gave the clerk my new logbook and asked her to read out what the yellow bit was for its the bit you send if you sell it to a motor dealer so i asked her to phone dvla and find out if the yellow bit was attached guess what she replyed straight away it wasnt i saw one of the magistrates nudge the other and new then it was game over

this is the big con if you loose you pay dvla costs if you win you cant get any costs back at all from either the court or dvla i evan asked the clerk if i could hit dvla with a small claim and she said no that is just wrong

In the end I rang up the DVLA and argued my point and they gave me a 'discount' so that the money I was going to pay was less than they cost of petrol getting to court (not to mention the days lost wages as I am a contractor), so I paid the 'fee' as I just couldn't afford the cost of a fight on principle.
I'm still furious about this though. It's a scam that is being operated here, which if it were being done by a private company would be quickly shut down but because its DVLA its hushed up.

i was charged with being the registered keeper of a vehichle without insurance, [i had sold the vehicle 9 months previous]i had a £100 fine and refused to pay it so it ended in court in the waiting room the dvla prosecuter sat next to me and said she would still accept the original 100 to keep it out of court i said no she then reduced it too £35 i said no see you in court i will photocopy my defence it is easyer than me trying to write it

i am putting a pdf together with my defence so anybody in the same boat can ask for a copy the magistrate commended me on my defence that was centred around s7 interpretations act 1978 and a foi request from dvla the dvla tried to settle in the waiting room she tried every trick in the book to get me to settle before court
