Hi Natty, take a deep breath and don't worry! They may give these deadlines, but they are quite arbitrary; they aren't threatening court action or anything like that they are just trying to make you panic. Snv will be around with guidance for the best way forward. If you haven't heard from him in a couple of days send him a PM.
Do not speak to them on the phone and do not give them an I&E sheet.

Re: How could I let this happen again....

      Hi Natty

Sorry I missed this, my notifications were going to my spam folder and getting deleted.

So first question I'm going to ask you (and remind you of) is this - who is in control here? You or them?

Of course the correct answer is YOU.

So second question - why are you then jumping at shadows, and dancing to their tune? Just because they have sent you a response to your complaint (which you knew they would reject), and given you a 'deadline' doesn't really change anything. Emailing them stressing over dates will only encourage them to harrass you even more.

Remember - in terms of your priorities THEY ARE AT THE BOTTOM.

      So treat them that way.

They've given you 14 days to respond - so what? Let them gnash at their 14 days deadline, ignore them, and see what they send next.

Remember - since new rules came in around payday loans they CANNOT, by law, increase the balance of the account any more than double the principal sum lent. That is the worst case scenario.

So, lets go back to basics, provide info on this as per this thread, and we'll take things from there.

      http://forums.all-about-debt.co.uk/s...yday-Loan-debt

Please stop emailing/phoning them for now - you need to take back control of this account, and right now you're giving that to them.

No problem SnV. You are so right, it is just that this company scares me, I know that is was they want to do.

I will get the information in a few days, I have a lot going on with people close to me that are extremely ill. It is tough at the moment and I am trying to keep it together.

          Best wishes
          Natty

Hi Natty, I'd ignore the text. Remember, everything in writing ie letters.

I'm sorry you're having to deal with serious illnesses of those close to you. They are your priority and, as Cym says, don't forget to look after yourself. Debts are waaaaay down the line xx

I have also received 3 emails today. This is one of them:

                  Dear Natty

We refer to previous communications in this matter in particular the arrears on your account.

Despite our numerous efforts to resolve this with you we have been unable to reach a mutually agreeable solution and your account remains overdue.

TAKE NOTE: We will be referring your account to an external Debt Collection Agency 14 days from the date of this email if we do not receive realistic and acceptable proposals from you regarding the discharge of your balance.

If you are experiencing financial difficulties we urge you to get in touch so we can arrange a repayment plan and stop external recovery action. Please call us on 0845 676 9676*/0113 887 3434 to discuss your balance with one of our advisors

They have not made any attempts to resolve this matter.

External debt collectors are a good thing because it means they have not scared you into paying so have passed it on to someone else who they are hoping will be more successful with their letters that may even have scary big red headers

FANTASTIC! So you know now you have 14 days of doing nothing, and then probably approx 2-4 weeks for them to refer the account to an external DCA. So enjoy the peace and quiet, and lets see which DCA gets in touch.

In the meantime, do not respond to their texts, if they call do not answer security questions, or hang up, and do respond to their emails. When you get the first DCA letter lets take things from there.

Until then enjoy Xmas and take the holiday to get yourself and your family back to health ok?

                          Hello SnV,

Thank you for getting back to me. I agree totally with what you have stated.

I have been been here before (silly lady for letting this happen again)......

This company just scares the hell out of me. To be honest I was actually going to respond to the email. They have done nothing to resolve the issue & the 14 days was only up yesterday for me to respond. They also stated the letter was sent first class, when it was sent second. It was dated the 24/11/16 but received on the 30/11/16. I know this is irrelevant, but just really annoys me.

Thanks again for your support SnV. It is truly appreciated.

I received a total of 3 emails yesterday and will post the other 2 below.

                          kindest regards
                          Natty

This may increase your risk of experiencing financial difficulties or hardship. We will always treat you fairly. If you would like to seek free and independent debt advice, information on how you can do so is included within the attached FCA Arrears Information Sheet https://www.fca.org.uk/publication/i...et-arrears.pdf.

This shortfall equates to or exceeds the sum of the last two missed payments you were required to have made, which gave rise to the duty for us to serve this notice.

The opening balance (which is the total amount that is due and owing under this agreement) on 15/12/2016 (which was the day our duty to give this notice to you arose) was £580.72 of this, the payments that you have failed to pay when due under your credit agreement amount to £575.72.
