      One more question, as you all know this was going to go to the FOS/OFT but in their final response WDA said stage 2 was to go to BCCA first, which is in hand.When would the 6 months to complain to the FOS start, date of original complaint, date of final response or date of response from BCCA
      i.e should I start the ball rolling on the FOS/OFT complaint or leave well alone.

      I feel that i should do something about this letter as well, but to be honest just at the minute seems like to much hard work.
      Somewhere someone has posted a link to the OFT complaints form..any idea?

        Date of final response. Don't involve FOS etc yet
        I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. I am extremely busy so if you do contact me or need a reply to a forum post then use the email or PM features offered because I do miss things and get tied up for days at a time!

          What is BCAA saying?? Is it in relation to the debt I just did a letter for or another mate?

            Waged advance did a final response and told me to go to bcca if i was unhappy so i did,within time limits. No response yet.
            They then sold the debt to MML and i wrote to MML as soon as i got the NOA with a medical report (done for the other thing) copy of my benefit award letter and a letter stating what and why it was in dispute and hiding my doorstep.
            They replied today with the letter i posted.
            Not sent off you polite missive yet. Was thinking about a tactical nuclear missile aimed at protection house first

                  Ok MMF have written back requiring proof that i have escalated the matter. In have given them the name of the person at BCCA.
                  Do i just ignore or write back with the info?

                  Are WDA yanking my chain when they tell me stage 2 is the BCCA. If they are and they mess around i could miss out on the 6 month time limit for FOS.

                    Just ought to point out that in addition to the other points and response you've had this letter also breaches OFT guidance on debt collection, and also the guidance from the credit services association (of which Motormile finance are a member) in regards to their threats of court action.

                    The infer that a judgement will be a matter of course by stating:

                    "Once the judgement has been obtained"

                    They also breach guidelines with this piece of drivel:

                    "We could ultimately then refer the matter to the court bailiff to attend your property to recover the debt"

                    This is not to mention the entire letter would be frowned upon by a Judge and has blatant disregards to civil procedure rules.

                      Well i have emailed MMF telling them that
                      1) They have not dealt with the points raised in the last letter
                      2) The last letter was emailed on xxxxxx and read by Neil petty on xxxxxx at xxxxxx
                      3) If they read the letter they would see the name and email address of the person dealing with the stage 2 complaint
                      4) Seeing as they had breached so many guidelines i was forwarding their correspondence to the CSA. and the OFT.


                      I resisted all temptation to say i knew yorkshire people were thick or maybe the Scots had taken one dram too many.
                      I even resisted the offer of English lessons so they could read.

                      I also included my last letter and said I was posting it as well (to the freepost address)

                        We had a reply from Barry Ellershaw, account on indefinite hold until the BCCA complaint is dealt with.
                        Also had a reply from OFT logging my details ( I sent them a copy of MMF letter because i told MMF I would...and I am a man of my word!)

                          Now have ongoing complaints with BCCA regarding WDA and with CSA regarding motormouth finance. Mad though, CSA will now ask MMF to respond to my complaint..what's the use, they lied and made up the law before so why will they change. I have seen an identical letter to the one I had posted on cag and not one of the superstars over there picked up on the when we have the ccj bit (like Niddy did or was it SnV?))

                            I'm afraid the CSA will protect the interests of their members, but you can use the CSA guidelines against MMF to demonstrate their unreasonable behaviour.

                            Yes making presumptuous statements that they WILL obtain a CCJ is a breach of OFT guidelines and would be frowned upon in the very very highly unlikely event they took things to court.

                            Keep giving them enough rope to hang themselves - they will.

                            They'll then (unfortunately for them) move onto easier prey.

                              SnV. Sadly i am under no illusions about the csa however i will still have fos options which again will probably lead to nothing however it's more a point of principle at this point. It's not like i have any money to pay them.

                              Gives me something to focus on and if it all gets too much i can just let it drop.

                                I understand. However I'd also be inclined to drop things for a little while and let the dust settle down.

                                The trouble is that each time you correspond with them, you appear back on the radar and the process continues.

                                You've shown yourself to be a lot of trouble to them, so I'd be tempted to see if they put you in a 'leave alone' pile.
