Hi Winjas - just a suggestion.......

This IS a helpful forum, its just that occasionally posts can get missed. Can I suggest that a friendly bump of a post if there is no response is the best way to get a response, the post you made above is not. I know things can get stressful, and I know its easier said than done, but try to relax a little

I have been combating the PDL industry now for 3 years, have been instrumental is developing the common strategy to deal with PDL debt and educate people about it which has cost the PDL industry a LOT of money. On MSE I started to receive threats as the advice I was giving there was having such an impact so nothing would surprise me about the way they operate.

      At least I thought!

The statement you made below is the most bizarre and disturbing thing I have seen from the finance 'industry' when it comes to payday loans......

"Dear sir, thanks for complaint. Firstly our staff advised you to try Wonga as helpful service to customers to suggest other solutions of help if Barclays was unable to offer overdraft. The choice to enter into agreement with XYZ was your choice and not Barclays responsibility. We will not compensate or even apologise in any way for your own financial choices sir. Furthermore we consider this matter closed and our final findings on the matter. Should you wish to continue to cancel the CPAs you maybe able to do so via relevant dept and should contact them."
Erm seriously? You have this on headed paper from Barclays?

Admitting that their staff advised you to take a payday loan from Wonga as a 'Service'?

If so can you scan this (removing any personal information) and post this here please?

This is completely scandalous and I know several people who would be most interested in this story if this is true.

When you asked for the O/D what where the circumstances and what did you explain to staff at the branch at the time? Were you in financial difficulty, and were the staff in the Branch aware of this when they made their recommendation to take approach a PDL company?

Consider this - Barclays now refuse loans/mortgages from applicants with a PDL history on their credit file. Knowing this, how can they responsibly recommend that a Customer approach a PDL company as any sort of financial solution?!!

At the least this is appalling financial advice which is going to get (and did) a customer into a rapid spiral of debt.

If this is true I think you need to alert some of the high profile people tackling this industry (Stella Creasy, MP for example), as well as complaining to the OFT, FOS and even take your story to the national press..........

Re: Help, Barclays ignoring complaint AND wont cancel CPAs?

Typical of Barclays I'm afraid. Even their more senior staff are ignorant as pig #### when it comes to cancelling CPAs.

Re: Help, Barclays ignoring complaint AND wont cancel CPAs?

Thought i would update my Barclays crap....

Well thanks to whomever posted the emails for Mr Jenkins at the top, after three months of nonsense i finally got someone at head office acting on my complaint.

Today they replied saying as "a goodwill gesture" they would refund the 2 CPA payments and about £200 in fees caused by them. Which is all i ever wanted.

Frankly i am livid that they make out its a goodwill gesture on there part, when they breached the FSA Guidelines, almost tempted to decline there "offer" until they admit there errors but i cant be assed frankly..

There is as much chance of that happening as there is of Hell freezing over. Just take the offer and be glad to be out of that nasty situation with a break even result. That is a better result than I was expecting, and quicker than I was expecting it, so you must have put forward a strong and convincing case. Well done.

Is any of that offer compensation for your time, hassle and stress based on them directly breaching the lending code, OFT guidelines and referring you to an unregulated third party which only ever serves to get someone in more debt?

If not then I would take what they're offering but write back and complain more for personal compo, all they have done is refund monies unlawfully taken so you're no better off and have unnecessarily suffered for no reason.

This part is most relevant: --> Principles for use of Continuous Payment Authority - The Office of Fair Trading

Customers should not be misled regarding their rights to cancel. In particular, they should not be told they are required to contact the business before (or instead of) the payment service provider.
