Good evening all, I like many others read with interest the input on this superb site every evening and the inspiration, confidence and solace I have taken from it is unmeasurable, the warm hearted, polite and influential welcome from numerous members was absolutely unbelievable, the early days of fear, impending letters, phone calls, threats and the like, you all know, you've been there are long gone for me, others will be here in their early days looking for the same.
However recently it feels that the energy either collective or individual has been lost and it doesn't matter what thread I read it would seem there is an egotistical battle between some that is absolutely needless, boring and most of all unhelpful to those of us who are still seeking ongoing guidance when needed, we are all here for the same reason, we all have the same goal and each of us should be looking out for each other with content that will valuable moving forward either given or received regardless of status.
This is not a criticism but an observation with a sincerity that used to exist on this site, my apologies if anyone feels I have spoken out of turn but for the last 3 plus years I have found diaries, comments, replies and even personal phone calls all extremely helpful and long may this continue for all of us, I WILL NOT engage in any individual dialogue with anyone, it's positivity that's needed in these difficult times for those of us here that are still not out of the woods, anything negative, written or otherwise I'm sure would be better channelled elsewhere.

So you know absolutely NOTHING about AAD.
Well here is areal treat for you AAD well there are entries available from 2010 so you only need to look back what 14 years?

Banking Bad Debtors are written off against Tax so these nolonger appear on their Books. Nor BoE, nor the Treasury, hence the economy because they have been written off!
Please explain Oh fount of all knowledge why the Debtor isn't offered their Account Balance at pennies in the pound by The Banks.
Whats so special about these Corporate buying Bulk Accounts then being able to demand Face value for Debts that actually nolonger exist?
You will need to know what a Chose in Action is by the way! Fascinating reading for you!
The Consumer Credit Act is only from 1974 so what just 50 years or so to look at. Actually there are still existing working accounts and Credit Cards from 1960's just to add spice to your reading list.

Sadly if the amounts they quote are accurate, it goes over the threshold for a DRO.
To have any chance of getting these set aside they will need to show
a) They did not receive the claim
b) There is a realistic prospect of a defence
I would think if they are on low income or benefits they might be able to apply for a redetermination and if on benefits the court fee might be waived. This might and I stress might get the interest removed or stopped. So in this inspect legal advice might be useful if they can afford it.

There seems to be a serious misunderstanding on this thread which I think needs correcting.
Solicitors are exempt under Part 20 of the Financial Services and Markets Act 2000 from the requirement to be authorized by the FCA for any work directly linked to the legal services that law firms provide.
For example Joanna Connolly solicitors (JCS) specializes in consumer law, consumer credit, defending claims, set asides of default judgments and statutory demands as well as bankruptcy and insolvency.
JCS can therefore negotiate settlements/ defend claims with creditors where a consumer is involved, where there are legal issues (potential or otherwise). For example, (this is not an exhaustive list).
a) a Default Notice has been issued and is defective
b) A creditors non compliance with a s.78 or s.77 CCA requests which makes a credit agreement unenforceable temporarily
c) A credit agreement pre April 2007 is irredeemably unenforceable
d) the creditor has been making threats of legal action or for example there is harassment.
e) A claim has been issued
f) Enforcements by creditors on CCJ’s whether charging orders, attachment of earning s orders, third party orders etc,
g) Bailiffs
h) Claim for possession
Solicitors can, and do, advise on whether advice provided by Debt Management companies is correct and also can advise on whether a debt management plan or an IVA have been missold or the contracts in either case has not been adhered to by the provider..
Debt Relief Orders (otherwise known as DRO's) however are dealt with by CAB and other authorised debt advisors, though again advice can be obtained from a solicitor as to whether the DRO was appropriate or not.

2/ Financial Health Check (the horse has already bolted hasn't it? So need to get the Horse re-stabled again the Legal aspects first must be considered)
3/ Financial Planning Analysis - Well the AAD Diary of individual debts is a great start place for planning as so many AAD with attest to!
4/ Implementation and Review ( Again AAD has a wealth of experience here with Comments and shared advice from those sharing similar experiences)
@Stone has a CCJ and charge on His Property running at 8% from a claim raise by a Luxembourg based Company? Isn't Luxembourg like Jeresy outside of FCA and UK remit?

Where did you get your definition of holistic financial advice from- some recess of your mind?
Holistic advice will look at everything and consider the circumstances so maybe Shell has a case for being treated unfairly because of the trials and mental health challenges they face.
I do wonder why you insist on calling them a he- the only way you may know that is if you have been communication in private and giving debt advice- something you are patently unqualified to do.

Just want to apologise for the recent nonsense that’s been occurring between certain, known, users.
This is totally unacceptable and will not be tolerated on AAD. As such, the main culprits have been banned as it’s clear what they’re doing - certainly as we are aware of who they are which leads to this recent nonsense. Not your fault, or anyone else’s but it won’t continue. I’ll be more present on the forum and will deal with any such issues swiftly, should they reoccur.
Shell; my apologies that your diary has been messed up as a result of this squabbling. I’ll tidy it up later so only the relevant info remains.

Hello and thank you for the advice given,
Using forums and boards is a learning curve, hence the overwhelm with the replies, zero knowledge RE dealing with debt e.g. mistook unenforceable letter as CCA request I've a lot to learn and now realize that as CCJ this is no longer appropriate. I've now had Legal advice as recommended thank-you this enabled a starting point
As suggested SAR requests have gone to original debtors and companies perusing CCJ's and have responded to A.O.E. request with income and expenditure
Now have better understanding of how the forums and boards seem to work and will post up separate debts, when questions arise please correct me if i'm wrong.
The last 20 years of my life has been spent with worry, panic and shame about this debt really hoping i can learn and return the favor for others one day, I've learnt so much already
once again thanks
