Received letter of claim and it's scary!

  • Received letter of claim and it's scary!

    As title above. I received a letter dated the 24th of August (why a letter requiring a response within 30 days would take 2 weeks is something that bothers me, but that's a personal gripe).

    The letter is from Kearn's solicitors, who claim the debt was legally assigned to LC Asset 2 SARL, with Link Financial being appointed to administer and recover the account.

    I must admit I've been guilty of hoping this would all just go away, so am now desperately searching for some help with this. I have had a browse on the forum, and it seems I need to be wary of giving too much information about it until I know what you need.

    Welcome to AAD

    No two Debts are the same.

    LC Asset 2 SARL are apparently registered in Luxembourg (make a note of this for yourself and records because this might be significant)

    It would be helpful if you could provide more information using the AAD Diary format
    • Type of account -
    • Date commenced -
    • Approx balance -
    • Date last 'full' payment -
    • Arrangement -
    • Status - defaulted
    • Account owner -
    This helps you in taking control of your debt(s) and helps AAD Mods recommendations especially in dealing with Kearn's Letter

      • Approx balance - Just under £10k
      • Date last 'full' payment - Approx Feb 2020 (Unsure)
      • Arrangement - None, no payments made, no contact made
      • Status - defaulted, sometime in 2020, with DCA
      • Account owner - Bank of Scotland (Halifax) - appears to now be LC Asset SARL 2/Link Financial outsourcing
      This helps you in taking control of your debt(s) and helps AAD Mods recommendations especially in dealing with Kearn's Letter

        Ok, no need to panic and no need to be scared, honestly. We're all here to help.

        If you could set out the information Roger has suggested you provide, that would help and will be a good starting point for everyone to start assisting.

        I'm not sure I understand the beginning of your post. Are you saying their letter is dated 24th August and took two weeks to be received by you?

          One of my teenage children has opened the letter (I'll assume mistakenly) and left it in the living room. I can't say for certain it took 2 weeks, but it certainly appears that way. It's dated the 24th of August, but I discovered it on the 7th of September (complete with dog chew marks!) I doubt it had been there for more than a couple of days

              Thank you. I am currently having to use my mobile phone for the pictures, as I do not have a scanner. This is giving me pic files of approx 9mb each. Including front and back there are 10 sheets in total, which are the letter of claim, information notice on the reverse, 4 sheets for "reply form", 2 for Annex 1 information sheet, 1 for statement of account and one for financial statement. Please clarify which you need so I don't clog up your inbox/get it bounced for large file size etc

                          If you have a smart phone, there are a few free scanner apps that are designed to produce good quality images, including multiple pages and the file sizes are much smaller. There is an Adobe one which I think works well. Emails usually limit total file sizes to 20 - 25Mb per email, or reduce the file quality which can make them unreadable.

                            Hi, I have received your email.

                            Given the information I have before me, which is only information contained within a single letter; there is a very high probability the alleged agreement is 'irredeemably unenforceable', which means that breach can never be cured by the assignee.

                            I also have genuine suspicions, for good reason, that any Default Notice sent to you was defective, or not served at all. I would appreciate if you could email me any documentation you have, and I would hold off replying to anything until we have discussed this further.
