    HI SH,

    The default notice was dated 1st Nov, I got it on the 7th Nov, the rectification date was 24th Nov so it would appear to be ok I think.

    Niddy deemed this as the terms sent were not the originals, they are from a later date and MBNA have ignored the missing PTC`s I sent them.


    Can yo look at post 529 regarding the other 2 MBNA accounts, I think they both have defective default notices as they sold the account before the rectification date. Not too sure if i am correct on that though.

    Did we ever establish whether the default notice was compliant or not? It could be significant now you've reached this stage.

    Letter thanking me for one sent 9th May Missing PT`s. saying the documents supplied do comply (not according to the boss hehe) They are satisfied it is kosher and will administer it as normal. They want the OH`s money. Forgot to say that they say they state "We can also confirm that we have not provided you with a reconstituted copy"
    July 13th:
    Letter re card is in arrears. One comment in this one is "If you do not have a debit card that allows you to make an online or telephone payment, you can use one of the other payment methods detailed in your monthly statement" One of which is pay by credit card.
    July 19th:
    Letter saying OH is in breach of agreement and a decision has been taken to restrict the account.
    July 27th:
    Letter from MBNA saying 2 missed payments so they are registering this with the credit reference agencies. They still want money.
    10th August:
    Both Telephone harassment and the new Scottish doorstep collection letters sent
    15th August:
    3 letters from MBNA sending copies of the last 4 months statements
    17th August:
    Letter informing OH she is 3 months in arrears.
    21st August:
    Letter from MBNA saying they are currently investigating the complaint, re calls I think. Keven called twice yesterday and twice was told to F*ck Off as I told lies lol
    8th Sept:
    Letter asking me to contact them as they would like to offer assistance to prevent the termination of the agreement
    12th Sept:
    Notice of sum in arrears, no Office of fair Trading Information sheet included which they say is.
    12th Sept:
    Letter apologising for the delay in responding to my complaint re telephone calls. They will issue a response by 8th October 2012
    14th Sept:
    LOL Final response letter responding to the telephone calls complaint. They also ask for income/expenditure information.
    7th Nov:
    Letter from MBNA with a Default Notice.
    10th Nov:
    Letter with a Notice of sum in arrears

    2013

    14th Jan:
    Letter from them informing that this Credit Agreement has now been terminated.
    Afternoon All,

    Found one letter waiting on my return. Agreement has been terminated and they will keep me informed of any further action.

    I wish I was there with you! We had some heavy snow yesterday, although it is clearing now. It is a far more constructive way to spend money than giving it to DCA leeches, that's for sure.

    Hi Vint,

    Both MBNA accounts got a default notice dated 4th June 2010, rectification date 22nd June. Both refer to Paragraph 8 of the agreement.They sold both to Experto on the 15th June 2010

    No termination notice for either. I was under the impression they couldn`t sell till after the rectification date but I`m no expert. Neither had the OFT info sheet included, they said i should contact them if it wasn`t included. This was my pre AAD days.

    You need to look for the date that it was issued against the date for rctification. Also the clause that they state you have defaulted on.

    They can sell the debt at any time.

    Afternoon Folks,

    I now have a picture of my phone showing 8 calls received from the wankers.

    All received after the date on their letter saying they would only communicate in writing as requested.

    I`m now going to check all the default notices re the rectification dates etc.

    I know the 2 MBNA ones were sold to the Varde Experto lot prior to the rectification date.

    I think that might be helpful.

    Unfortunately the wamkers call my mobile BUT..... I can copy the screen display which tells me 8 calls. It only gives the last date but at least it tells me how many.
    Pity it aint me house phone with truecall.

    Many thanks for mentioning the idea of a picture of the screen., I never thought of that myself. (Mental note, Pic of the mobile)

    Have you got evidence of these calls? It could come in extremely useful if you were ever threatened with legal action in this case.

    I have to admit I'm not really familiar with cell phones and what they can record and what they can't. Even if the times only came up on display, it might be possible to scan the display or take a picture of it.
