      Hi spankd1

You can use the number as Pixie has suggested. However do not be intimidated by the phone calls. Do not go through security, do not discuss your debt at all with them, tell in writing only and PUT THE PHONE DOWN! log the time, date and basic content of the call, from whom about what etc. This can be very useful later on if things get heavy. At the moment its all bullying and posturing to get you to come to heel.

      regards

Totally agree, just fail security then if they start to discuss things, you got em under DPA breaches...... it's easy to say it was not you that answered the phone when they started bleating about your account to your mate!

          Re: spankd1's Unenforceability Diary

Hi again, hope you all had a good christmas - I did - totally ignored the DCA's so we could enjoy ourselves. Amazing how they decided to write in the week running up to Christmas after weeks of nothing but phone calls - almost like they just wanted to try and spoil it for me??!! Anyway, sent letters requesting time to 'take advice on the account'. I didn't specify who from so they won't know if it's to check it's enforceability or to get a DMP company involved but I plan to put together my own DMP and make reduced payment offers. I was going to do this this week but the only thing stopping me really is whether I should be sending the 'missing prescribed terms' letter as mentioned above as none of these companies appear to have the proper agreements to hand. The other thing is Amex have sent a copy of an application etc which I'm not sure is what I requested anyway - will forward to Niddy for his opinion. But, not really sure what to do now???

                      Are you doing a dmp?

I can pass you details of our dmp specialist that will be able to do it for you for free if that's the route you've decided?

I was referring to the 'Amex rubbish' I sent you - had a notice of legal action sent so I need to act soon - one way or another. Need to know if it's any more enforceable than it was before???
