Latest installment of trouble 8-1-2011 - Amex this time(Agreement previously deemed UE)

Hope everyone is doing ok ...it seems as though things are starting to hot up for me,the worrying thing is there are many more of these potentially lurking in the background.

Received a letter today from HL Legal collections advising me that they are acting on behalf of AIC who in turn are acting on behalf of Amex & that I must pay outstanding balance in full in 7 days or contact AIC to discuss payment - if not legal proceedings will commence without further notice.
They go on to threaten charging orders, bailiffs and bankruptcy etc.

AIC have had the letters informing them that the account is in dispute etc and have ignored them.

There seems to be a trend developing here - stick em in court and see what happens.
(What worries me is there are many more of these lurking in the background)

I wouldnt mind but I have an ongoing claim with Amex for unfair charges etc, which is well in excess of the outstanding balance - guess what though ....they are not taking the claim seriously and are treating it & me with contempt.

Has anyone else had experience of this lot re Amex and AIC? - If you have I wouldnt mind knowing how you got on.

Any ideas on this one - I guess I respond with 'threat of legal action template' ,they say that I must respond to AIC,who havnt had this template yet, and then just wait for the inevitable.

        Regards

        Matty

          Hi Matty

I have had some correspondance with AIC and I have to say they ain't the brightest, they also seem to be incapable of actually reading a letter. If you google them you'll find lots of bluster and threats but not actually that much in the way of constructive money gathering, try not to worry. Check the address of HL Legal, its not another desk at AIC is it? I am embarrassed to say AIC appear to be based in Glasgow, I could always send Mr Dopey and the boys around if it comes to that. Now Amex are a lot of bluster as well, I had a complaint with them when we were on the DMP last year as they were loading more interest on than the payment they were getting, I complained to the FOS after one of their pig ignorant operatives told me they were an American company and they could do what they liked, FOS sorted them out quicksmart, wiped the interest, stopped the interest and compensated me to the tune of £50. Then they supplied a fraudulent CCA so its UE as well. It just goes to show that these guys CANNOT do what they like and drive a bus willynilly through guidelines and laws, somebody just has to say NO. They get away with it because the vast majority don't complain. You're just having a rough time at the moment, wait to see what Niddy says but I would send the Threatogram, check with Niddy though. and remember we're here for you, this is all a bugger but it isn't the worst thing that could happen, chin up.

            Hi Matty

As you know I follow your diary with particular interest. I'd listen to what Dopey has to say and try not to worry - wait and see what Niddy recommends.

I think you might be right though about this. Are they reckoning on people making payments to avoid the possibilty of court, even if the cca is UE? Is it a case of calling their bluff, I don't know? :confusing

Hopefully Niddy will be along later to provide an answer. Good luck x

Matty i have had two letters from HL Legal on two different accounts saying exactly the same.

To date they have done nothing else, one of these arrived 6 months ago.

It's a scare tactic nothing more, try not to worry.

Hi Peeps - long time no speak(on this section at least)!
Anyway I had a letter from Blair Oliver & Scott re a BOS account and sent them off the sold whilst in dispute template.
I have received anothe letter from them 'pay up or else ' further action ,doorstep visit etc.
I think our letters crossed in the post,so not sure if to give them a few days or bang off the threat of legal action - the latter me thinks.
Also wondered how other people have got on with this lot as they are new to me.

                              Morning.
I had a couple of letters from triton re my Natwest account in december which i responded to with the appropriate templates.
I have now had a letter from Natwest,I assume in response to tirton contacting them further to my letters, saying:
That they have complied with my request under S78 etc and that there is no obligation on their part to provide a copy of the original agreement bearing signatures etc.....and that the amount remains due and that they will pursue me for the same...etc etc.
Its a standard response I assume, resulting in stalemate between us - question is ,do I need to reply to it or just file it and see wait for the next move?
The latter me thinks, but just thought I'd check.
