This is the first I have heard from them & contains the usual stuff - ring us now,pay up now etc etc.
I was going to send them the usual 'sold whilst in dispute' letter.
However they mention that if I dont make a payment today - SCM solicitors MAY commence legal proceedings.
SCM have written to me about these accounts previously & they got the 'threat of legal proccedings' letter back - I have not heard of them since sending this letter 6 weeks ago.

Do I just ignore the reference to SCM for now & send off the 'sold whilst in dispute' letter ?

Matty, just send this to both: ---> viewtopic.php?p=20203#p20203

Somewhat contrived me thinks - is there a postage class that takes 6 days or have they just dated it to suit them and to ensure that I cannot comply.

I guess the letters have crossed in the post.

Question is - do I send them the threat of legal action letter, ring em to tell them that I have already responded or give it a few days?

See bold part above matey, as i've not replied til now - you can assume my thoughts were to ignore them for the moment. However, have they signed for the last letter you sent yet, if so - when?

I do not have a time nor inclination to rush in to answer them - they do not pay me for this.
All these threats about 7 days, 5 days, 3 days, 48 hours, etc. are only blatant threats from my experience. Especially as they can't back it 'cos they all use 2nd class mail service.
Have you noticed that there is NEVER specified date but ALWAYS "opportunity" time frame?
If they were serious, treated you with respect and adhere to logic, common sense and business code, they'd use specified dates with enough time to respond: for instance quoting 15th December in letter dated and sent on 1st December, instead of rubbish 48 hours...
48 hours from when? You have no idea so how can you comply?
I personally draft response letters during the weekend irrespective the weekday they landed on my doormat and send them in batches on Mondays.
Unless it is a court letter, there is no rush. But even then, I'd use all my allowed time to not respond without asking for help on here and considering all my options.
Rushing with responds put you under unnecessary stress and can result in mistakes which you can wholeheartedly regret in the future.
        NO RUSH ya
        Hi Jadex (stranger) ya

Wise words, thanks - and also spot on! There is no rush, and as I always say - i'm ALWAYS lurking and if something needs immediate response, I will respond. If I don't, it means I don't think it is that urgent.... Matty, guess you figured that alreayd hehe nah

        Cheers

                Update 16-12-2010

Hi peeps - been quiet for a week or so....
Postman made up for it today with 12 letters.

                Including:

2 from Calders re each of my Barclaycard accounts - you must pay now etc etc .
This is the first time I have heard from this lot - so I will send the latest 'sold in dispute' template.

1 from Restons re my GM Card - very short & sweet 'We are instructed to commence legal proceedings against me forthwith'.

They have written to me twice before and received the relevant templates in response from me.
1: Threat of legal action template 27-9-2010
                2: Signature refusal template 29-9-2010.

Not a dicky bird since....until today.

I guess I just wait until said legal action commences.

Finally letter from LTSB saying that the agreement I signed is valid & that I am obliged to make monthly payments etc.
They go on to say that some customers wrongly believe they are entitled to an original signed copy of the agreement.

That it is a misapprehension that section 78 provides debtors with the right to obtain a copy of the original signed agreement etc etc.

They go on & on that they are right & I am wrong.....blah blah....stalemate really.

strangely though the last line says that they have closed their file - does this mean they have given up (me thinks not)??

I wil just file this & wait for their next move

For the time being send the letter below to Moorcroft; it will buy you some time I guess as they don't like taking things through court - they are not one of the worse for taking action so i'd say blag it a wee bit longer. You can always back down and settle things when court papers are served, don't worry about that.

But in the meantime, send this to Moorcroft: ---> viewtopic.php?p=2318#p2318
                  Morning Boss.

Had a letter from M&S in response(I think) to the letter above to Moorcroft.
They reitterate that they have sent me the information requested in july( enclosed a further copy of the CCA) and that they believe that the agreement is legally enforceable and as such refute my alegations.
Nothing to do for now but wait I guess - no doubt this letter is lining me up for commencing legal proceedings.

                  Matty.

Lets wait and see what happens, hopefully they'll sell the account then we can get the DCA to bugger off - who knows, they may just dive in for a CCJ (as they seem to be doing a lot lately)....

                                Update 6-1-2011

After months of waiting finally received SAR info from MBNA on the 3 accounts I have with them.
They sent me 2 further copies of application / acceptance forms previously deemed UE by his Nidship, along with reems of guff.
                                interestingly though:
1: They have still not come up with ANYTHING in relation to my A&L(now MBNA) account.
                                &
2:The T&Cs for both the MBNA accounts show my current address - which was not where I lived when I applied for one of the cards and they also detail default charges at £12 which I believe didnt come into affect until after the OFT report in 2006 - which was 10 years after the accounts were opened.......me smells a rat here somewhere or at least that they have made these up as they have gone along.

I will file for now as they might come in usefull if they decide to take me to court.

                                Regards,

                                Matty.
