    M&S (Enforcable)
    Received a letter on Saturday from Moorcroft (Pre Court) Division, which the say is a notice of intended litigation and that to prevent them from recommending that their client should commence legal proceedings payment must be made in full within 7 days.
    If an agreement cannot be reached by 25/11/2010 a claim may be issued by their client without further notice.

    Is it now time to ring M&S to try and get a payment plan in place?

    I was hoping to drag this out a little longer and try to do a F&F once I get enough money together.

      Hiya

      For the time being send the letter below to Moorcroft; it will buy you some time I guess as they don't like taking things through court - they are not one of the worse for taking action so i'd say blag it a wee bit longer. You can always back down and settle things when court papers are served, don't worry about that.

      But in the meantime, send this to Moorcroft: ---> viewtopic.php?p=2318#p2318

            Morning ya
            Amex - UE as advised by his Nidship.
            Received a letter from Allied International Credit,who have been instructed by Amex to pursue this account.
            This is the first letter from them,Newmans have been dealing with this previously.
            I assume I send them the sold whilst in dispute letter - just wanted to make sure.

                    Quick question if I may your Nidship.

                    I keep getting letters from Albion DCA re BOS accounts,threatening with doorstep visits etc and have no problem with ringing them to tell them that they and their agents do not have my permission to visit my property etc etc (they have had all the relevant letters etc) which puts the account on hold for 10 days....then it starts all over again :what
                    I got into a long discussion with them this week re implied rights and that the accounts are in dispute etc....they say that the last letter they have from BOS is a copy of a letter to me saying that they have fullfilled their dutied and complied with sending a valid / compliant CCA & that is why they are chasing me.
                    Its a stand off / stalemate situation,which is no doubt the same with all my other lenders where the CCA is deemed as UE but not admitted as yet by them.

                    Do I need to send another letter to BOS to reitterate my position or just leave it be for now?

                      Hiya, you just ignore HBOS but any DCA's that write you need to respond to cos the lender usually sells the account (or passes it on) without telling them that you're querying it. In future try and not speak to them, although fun - it doesn't get you anywhere cos the muppets that answer the phone cannot and do not have authority to amend anything when they have established they are speaking to the debtor.

                      Just ignore them. If they want to take action, we'll fight it then.

                          Received 2 letters from MHA collections - 1 for each of my LTSB accounts.
                          This is the first I have heard from them & contains the usual stuff - ring us now,pay up now etc etc.
                          I was going to send them the usual 'sold whilst in dispute' letter.
                          However they mention that if I dont make a payment today - SCM solicitors MAY commence legal proceedings.
                          SCM have written to me about these accounts previously & they got the 'threat of legal proccedings' letter back - I have not heard of them since sending this letter 6 weeks ago.

                          Do I just ignore the reference to SCM for now & send off the 'sold whilst in dispute' letter ?

                            Hiya Niddy - bit of advice needed please.
                            Sent them the letter as advised above last Friday & have received another letter from them today dated the 23/11/2010 demanding I respond /ring them/ pay in full within three days of the date of their letter or they will instruct their clients to arrange for the issue of proceedings against me.
                            This is my final opportunity to resolve the matter etc etc
                            Somewhat contrived me thinks - is there a postage class that takes 6 days or have they just dated it to suit them and to ensure that I cannot comply.

                            I guess the letters have crossed in the post.

                            Question is - do I send them the threat of legal action letter,ring em to tell them that I have already responded or give it a few days?

                              I can tell you what I do - it's not the advice, just pure information.
                              I do ignore all the letters coming through the week, I do read them but do nothing untill weekend.
                              I do not have a time nor inclination to rush in to answer them - they do not pay me for this.
                              All these threats about 7 days, 5 days, 3 days, 48 hours, etc. are only blatant threats from my experience. Especially as they can't back it 'cos they all use 2nd class mail service.
                              Have you noticed that there is NEVER specified date but ALWAYS "opportunity" time frame?
                              If they were serious, treated you with respect and adhere to logic, common sense and business code, they'd use specified dates with enough time to respond: for instance quoting 15th December in letter dated and sent on 1st December, instead of rubbish 48 hours...
                              48 hours from when? You have no idea so how can you comply?
                              I personally draft response letters during the weekend irrespective the weekday they landed on my doormat and send them in batches on Mondays.
                              Unless it is a court letter, there is no rush. But even then, I'd use all my allowed time to not respond without asking for help on here and considering all my options.
                              Rushing with responds put you under unnecessary stress and can result in mistakes which you can wholeheartedly regret in the future.

                                Thanks for your post / comments Jadex.
                                I am learning (slowly) which letters to ignore or respond to with his nidships help along with others on here - I get a lot of them and as you say most are try on of one form or another to panic / scare you into contacting them.
                                Its the threat of legal action which still worries me , but as you say,until court papers arrive that is all they are - a threat.
