      Hi all.

      Well it seems that Newmans have now given up and RBS have now passed my file to Westcot to Chase. Received a letter off them this morning. I will send them the account sold in dispute letter but can I just check that its ok to do this.. because.. RBS sent me the CCA which was deemed U/E by Niddy but I have never actually written back to RBS to tell them this so they have not been informed that its U/E or that the account is in fact in dispute. I shall send the letter to Westcot but do I actually need to inform RBS that its in dispute?

        I would send this to Westcot --> Account Sold whilst in Dispute

        No need to inform RBS.......

            Hello and Happy New Year all!

            I sent the account sold in dispute letter to Wescot and then on the 21ar December I received a final notice letter from them which I ignored. I then got a letter from Nelson Guest and Partners Solicitors (colour, set up and font is almost identical to MCL), this letter states that Westcot are prepared to offer me an early payment discount, doesnt say how much. I ignored this.

            I have now received another letter from Wescot dated 2nd January which says:

            Following your recent request for a copy of the signed agreement, our client has requested you write the following address and state in your covering letter that this is a section 77/78 request and enclose a £1 postal order or cheque payable to our client.

            Any ideas what I should do now?

              Is this still the RBS issue?

              If it is, I would just ignore this latest pile of dung as it is facetious and irrelevant. You have already sent a fully compliant request, to which the bank has already responded (albeit with non-compliant paperwork). Why on Earth would you want to send a duplicate?

              Not worth wasting a stamp on, IMHO.

                Yes SH its one and the same account! Well yes thats what I thought as the 'account sold in dispute' letter I sent them clearly states the bank have failed to comply with my request... so obviously I have already done what they are asking me to do again!! I will ignore this then. Thanks

                  Daughter has had all those, funny order they came in from Wescot, seems to have gone quiet for a while as they say 30 days wait to Get stuff from o.c.Must get something any day now.

                    Well its obvious that Westcot have not been in touch with RBS or surely they would know that a request had already been made! Bunch of idiots the lot of them.

                    One of mine went quiet and not heard anything for over 6 months so im expecting to hear from them.. hope I dont but I cant see them leaving it

                      Hi everyone, worrying development on Saturday as I received a letter from Mortimer Clark (acting on behalf of Marlin who were assigned the debt from Yorkshire Bank.. not a good combo these three).. anyway they have miraculously managed to find my CCA.. Marlin couldnt find it when I asked them for it over a year ago!! Anyway I have uploaded it for Niddy, lets hope its UE as this combo worries me.

                        I am now receiving regular calls from Westcot and they have done a trace search of my credit file which is very odd considering in the letter I got from them on the 21.12.12 they clearly state that after several checks they have determined that I am resident at this address.. why then the trace!! They seem to be ignoring my account sold in dispute letter and carrying on as normal with the harrassment. Any ideas?

                            Cheers, I will just hang on for next letter then and not waste money on a stamp. When I do write though Im gonna tell them to get that trace search removed off my credit file, they know full well where im living and have even stated that in a letter! Idiots!!

                              As far as i know, trace searches dont harm your CRA, do they? its not a search based on credit score for a loan etc.
