Thanks everyone! Yes another one bites the dust! Debt is only £174.00 but its £174 I aint paying. Over the years ive probably paid the vultures more than they paid for it anyway!!

Hi everyone! Just received letter from Lewis Debt Recovery re my (big) loan being handled by CL Finance. Basically saying they have tried contacting my old DCA with no joy, its some time since they received a payment (yes October) and they cannot continue to hold my account indefinately, if no contact within 10 days they will pass it back to collections dept. Well this is first ive heard of Lewis Debt Recovery, I thought CL Finance were dealing with it!

Anyway.. should I ignore for now??

Niddy.. would you do me a favour please and have another quick look at the CCA and see if theres any way it could be UE? Thank you

Ok will do, I emailed it a few weeks back and he thought it was enforceable. I did send it to the wrong place though so its not showing in my cca diary thing. Will fish it out and upload it again! Thank you

Isnt my other CCA in a secure thread? Its in the CCA uploaded area bit that can only be seen by me and you.. i think

Just trying to find the CCA on laptop.. ive a feeling i deleted it after i sent it so may have to copy it at work and send it to myself again

Hi Niddy, ive now uploaded the CCA for CL Finance into the secure area for you to have a look!

Received another letter from Cabot today re the Yorkshire Bank Overdraft, it says:

Unfortunately we are still waiting for Yorkshire Bank to provide the requested information. Although Cabot has again requested the information, the original lender is experiencing a delay in retrieving the information from its archives. We shall send the information to you as soon as we receive it.

Mixed messages here.. first they say they dont have to send it because my account is pre the new legislation, now they say they are trying to get it!! Make your mind up please!!

who is the lender, ie did CL Finance issue loans? I can see Retail financial services on the agreement but that means nothing to me as half these firms are now dead so can you clarify who the loan was issued by?

Hiya, the loan was from Bank of Scotland (but it says retail financial services as well as Bank of Scotland on the accompanying letter I got with my copy of the original CCA (which I have) but the copy of the CCA I have is not signed, yet the one they have sent is signed and dated by me which is odd!

Actually Niddy its very confusing as the agreement letter is from Bank of Scotland (not RBS), and when it went into default I had been paying GE Money and Santander (it was Santander that defaulted me) - presume these were all part of same company or it must have been sold on, it has had many, many owners and now ended up with CL Finance. I got the loan over the phone from an ad in the paper and the cheque was delivered by courier.. very strange set up!! Not sure if any of this is relevant but thought would mention it!!
