I didn't search for enforceability either. Initially I was looking for template letters to offer settlements, found the CAG site .. wasn't impressed. Then found the MSE site and saw old posts from Niddy. Think I then googled something and put Never in Doubt on the end of the search and found a post on this site!

Everyone has been very helpful and for the first time I don't feel alone with my debt cloud. Massive thank you to all!!

There isn't one to set up - you simply click the link then add the address to your email client, however you need to send things to agreements@all-about-debt.co.uk not the niddy address as you did as others can access the Niddy address.......

However, the agreement is enforceable - from first glance. The only downside is the terms are dodgy, easy to rectify but still......Not looking good unfortunately.

The only thing I can suggest is to see what happens, ie act as though it's UE and keep us updated - if they get stroppy then time to consider repayment options i'm afraid.

However for now, see what they send you back next.....

I suppose the worries I had with CAG in the early days sprang from my own desire to know in depth what was going on. I started there about the beginning of 2009, and followed through for quite a long time. The more I delved into solving our own problems the more I realised that contradiction, outright falsehoods, and worst of all a party line were being imposed upon the members. Some of whom were ending up in worse trouble than when they started, a typical DMP/IVA et al company problem. From the plethora of phone calls we were getting at that time from CMCs cold calling with something that was too good to be true led me to start digging and digging deep, we had no choice at the time. That bit of knowledge gained told me all I needed to know about what was really happening there.

Now we have, in AAD, a place we can all come, there is only one party line as I see it here and that is to kick as much arse as is pocssible on behalf of our members and users.

I think Pooks, the owner of this thread would agree as well, as they have come a long way from day one of joining us.

        regards

Thanks for having a look Niddy, I had a feeling this one might be as its such a big loan. I did wonder though as I couldnt find the cooling off thing on it but maybe you dont get them on a loan.

I will sit it out and see what happens then and set up a payment plan when they get stroppy, the default for this drops off my credit file this month (or should do, however another default should have dropped off in October and its still showing!) so the only thing i need to avoid is a ccj. When worst comes to worst and they want a payment plan, can I offer them a low one or are they gonna want stupid money? (I was paying them £47 a month on the dmp)

They were happy to discuss UE although it was mostly referred to as 'the CCA route', UE was a term more widely used by the claims management industry which is where I started (but got out just in time!). At that time CAG were helpful and showed me the way, I was really pleased to find out I could do it all myself, up to that point I'd always thought UE was something that had to be handled by specialists (such as CMCs) who would know all the technicalities and legal issues. This forum didn't exist when I sent out my CCA requests! I'm glad it's here now!

Over the past year or so CAG seem to have totally lost the way, offering rather inconsistent advice and telling people "it's no longer possible to get out of paying due to paperwork errors" which, at least in my experience, it's NOT TRUE!

I'm aware there are people out there (such as Garlok) who received very poor advice from that site even years ago, I guess the inconsistencies have always been there.

It's nice to have a site like this where everyone sticks together and works towards the same goals , it's really disgraceful that other forums that claim to help the consumer should focus more on rivalries between forums rather than working together to help people.
Yes I noticed that when I was looking on CAG that someone would ask for advice and get given totally opposite advice from different posters, who then argued amongst themselves. Some appeared to get lots of help and others hardly any response. But the general message seemed to be stop trying to avoid paying and either set up a payment plan or offer a full and final. I did get an impression that some of the 'advice givers' were actually dca's themselves..... or course this probably wssnt the case but its what it looked like.

Exactly, I have never had to wait for advice or an answer. I cannot express how grateful I am to everyone on here for giving their time to help me.

I found this site through a recommendation from a member over there who is also a member on here. That person knows who they are and I thank them most sincerely. I wouldn't have found this site but for that private message that was sent suggesting that I check out this character called Niddy. I really don't know where I would be know if they/I hadn't done what they/I did. I wasn't getting much response from my requests there TBF. I came here and I have had nothing but help, at all hours if needed. I thank each and every person who contributes on here. FANTASTIC

Do you know, funny you should say that. I went on last night just to check on the PM's that I got and I noticed that it said Noddy. I thought, how did I find Niddy then?

(another stroke of luck in the BT UE journey. As long as there's more good than bad then I'll be happy)

                                Thanks FP!
