Yes but you will find that the advice here is to only send the letters for really important scenarios. Just look at the number of times that the advice is ignore! Cost = nowt

Also, if ever anything does go further, you have proof of delivery - it's all too easy for things to get 'lost in the post' as it where.

Absolutely right FP. The clock starts at the point of the first missed payment if I remember one of Paul's posts correctly.

Easiest way of working out the time start date, it is a day after the date of the first missed payment. A lot of people say it's the day after you last made a payment, but don't be fooled - you pay in advance with certain products remember

Therefore, assume you last paid into your loan on 1st January, with the next payment due on 1st February and you missed this, the SB clock would start ticking from 2nd February as that is when you actually fell into arrears with the account. Up until this point you are not in arrears you see

Just trying to make it easier to understand, lots of mistakes regards the date as people sometimes class it from the date you last paid -

FP - sorry I wasn't quoting you as if you were wrong, your info is spot on (as is Garloks) - I was only trying to simplify the working out part of it and quoted you, cos you were the lucky one

Thing is though why do people try and force/rush it through? Not being funny but if you're not 100% sure and have waited over 5 years then seriously, sod risking it - stay off the radar for another few months to be 100% sure.

I remember on MSE someone waited for *6 years* then applied at the same bank for credit, that she had an old debt for. She mistakenly presumed because her credit file was clear, the debt had become SB (think about this...)

I responded saying, no - you're wrong because XYZ and got shot down in flames. The poster applied - flatly rejected. A week or two later, the lender (Barclays) wrote asking for repayment of the old debt, the poster wrote back (based on posts on her thread) basically saying "its SB go away I owe nothing, I did, but not now". Hah

THAT reset the clock as she admitted liability - the worse thing was, it was only 2 weeks wrong..... two weeks was all she messed up with!

              Gutted

You know her mistake (and those planks on MSE that replied)? They presumed that as the credit file entry had gone the debt "must be" SB'd. I asked why? I knew of loads of accounts that were over 6 years into a repayment plan, thus the default had gone but they were in no way anywhere near SB (they were still being repaid FFS)! I explained as well, that most data to CRA's is backdated and should not be trusted - but the fact the account didn't show, the poster thought she knew best.......

Hi, just read all the posts (and the ones after this).. im a bit thick at times..like its been said, its better to pay the post office for the odd recorded delivery than to keep paying the debt so thats what I shall do!! Just on the subject of SB, I defaulted on all the debts, they are all in arrears, the bits ive paid off them (last payment made in October) wont have brought me out of arrears soooo.... is it 6 years from October of from the true date of the arrears. Seems very complicated haha!!

I have received another cca today, I have updated my diary and sent it you but had to send it to your address through my hotmail as i cant seem to use the one on here.. not sure how to set up an account!

Oh.. can I ask another question please as I keep making a decision and then changing my mind! Right.. the Cabot debt for the overdraft which isnt covered for CCA. Last paid in October. I initially was gonna offer them a reduced payment plan (was paying £5 and odd pence through dmp), then I changed my mind and decided to offer them a low full and final instead and got the letter all ready BUT.. am I better waiting for them to contact me for a payment before I make any offer or just go ahead with the offer now?

As for CAG .. this was the first site I found and was very nearly put off even going up against the creditors. Nobody could seem to agree and the overiding message seemed to be anti going down the CCA route as this was seen as trying to avoid paying the debts. Thank goodness for Niddy!!

It's 6 years from October now so your debts will be SB around November 2017

Wait till they get stroppy then we'll sort the offer thing out for you - don't do anything without letting me know as we'll get this sorted at the best rate possible

                            hey Pooks, like the avatar!

Sadly Niddy is right, CAG has gone down hill fast and you probably have read our "have you been banned from CAG" thread. Unfortunately an awful lot of the other forums have gone the same route.

It is inevitable in my view that attempts will be made by the financial sector and their parasitic hangers-on to infiltrate the forums which offer sensible support like this one and make people aware of their rights under the law. Some of course have succumbed as well to the lure of thirty pieces of silver crossing their grubby palms.

Niddy and the senior mods here weed 'em all out pretty quick before they get a chance to start problems. It is unfortunate indeed that should you enter anything like "Consumer Credit Act" in your search engine, CAG appears first and you need to read down a long list to find the other sites.

                            regards
                            Garlok

This won't always be the case, it's purely that most internet users click the top link, so end up at CAG and also they're the oldest forum so they have the archive of things....

If you search Google for unenforceability then you'll see things sway more this end (we're third in the list - albeit underneath MSE & CAG) but you'll see we are above LB in less than a year of being here

I agree mate, but when I started out I would have never thought of putting UE in my search engine and wonder if others who are new also wouldn't think. They like me would put CCA because of the news media attention it once received or consumer rights something like that.

However as you have said before, AAD provides a quality of service that the others cannot achieve and you would rather have 10 people really in need that we can help than 100 a day most of whom would be out to cause trouble.
