    Re: Pookies UE Diary

    Hi Pooks,

Pixie is right there, however you could offer a lower figure per month as a start, tell them thats it. Remember that they will have purchased that debt at something like 10p to 12p in the pound. If they don't actually own it by Assignment in Absolute then I would tell them to go and whistle as they could do nothing without the original creditor's involvement. So onwards, if you get them to accept that lower figure, save the difference yourself and in a few months time make them an offer in Full & Final. As a rule of thumb start at the 10% of the outstanding balance and work up in low increments to about 20% (gives them 100% profit on the purchase remember) if they refuse, then take the offer off the table and continue to pay the payments for a few more months and try again. It is more than likely they will come back to the table for a second round at that point stick hard at around 15% and let it rise all so slowly towards the 20 mark again. In the end you are likely to get a 25% settlement I would have thought. Its almost like playing poker.

    regards
    Garlok

      Thanks Garlok,

How do I find out if they actualy own the debt? They refused to send me the cca and sent me my postal order back saying they dont have to send it because its exempt from the regulations due to it
      being an account overdraft.

        Hi Pooks,

As with all debt sales, you should been sent a Notice of Assignment, i.e. a letter EITHER from the original creditor OR from the debt purchaser which tells you of the new ownership. These are such darned loose things that it can even be a mention in another letter about something else but nevertheless you should be made aware of the new owner.

You are unlikely to get to see the docs themselves but you could ask them to prove they own the debt and under The Copies of Documents Regulations provide you with a copy of the Deed of Assignment. You will probably get drivel back and all sorts of excuses but it will serve as an NoA so you will know where you are. Then you could proceed as I suggested above in the sure knowledge that are not just acting as agents for the OC.

        regards

Thanks Garlok, is there a standard letter I can send or just write to them as per above quoting the regs?

I dont have a scanner, I am going to see if I can scan and email it to myself at work on Monday but if that doesnt work or I cant do it does anyone know of any other way I can email it to Niddy?

            Thanks, Pooks
            this is

Its also got PPi so if necessary we can look at a reclaim later on, which would lower the already small debt, to make it easy to F&F if necessary (to avoid court)...

Also had reply from Cabot who have sent my postal order back and state there is no need for them to provide a copy of my credit agreement as it does not apply to current accounts. They go on to say i have a £1206 balance and a payment plan for arranged for monthly instalments of £5.47.. hmmm not any more! Should I now contact Cabot and arrange to continue paying this privately?

              Thanks, Pooks
correct, you ought to be trying to make a F&F, say around £100 to close this.... if you have it of course?

Hi Niddy, just before I found this site I stupidly offered a full and final of just under 60% (about £600 it was) but they refused and offered me a counter settlement of £900. I have £100 but if I cant go down the CCA route and they have already refused a much higher offer, dont they have all the balls in their court?

                  Thanks, Pooks

I don't know a lot about F&Fs but if they refuse the F&F of £100, just carry on paying the £5.47 then try again in a few months.

                      Re: Pookies UE Diary

I think I would agree with you here Pixie. I would also suggest to Pooks that she has a good read of the F & F stuff around the site before making any further move on that front. Yes, after that make the £100 offer then move up a couple of times in £50 increments (only if you can afford it), then pull the offer off the table, tell them that your expenses have gone up ( e.g. energy costs) so that you are reducing your payments by a quid a month or so. Run with it for a while as Pixie says then make the offer again say £150 as a once only offer. There are template letters to start you off here on site.

                      regards

                        Thank you Garlock and Pixie,

I will write to Cabot and offer them what they were getting through dmp then and keep paying it for a couple of months, then try again with a full and final. I had a good read about this a few weeks ago when I found this site.. just wish I had found the site earlier!

Do you know what I do now about the unenforceable debt i have with RBS? Do I need to do anything or just wait for them to get in touch, which they will now im not paying anymore!

                        Regards, Pooks

as pixie says - see what they say! a month can be the difference between acceptance of a £100 offer or a £600 offer - it really does depend how serious they feel the account is (ie how serious you are about not paying)...

I emailed you a moment ago, maybe this was a crossover so please ignore it. Thanks

From what has been said I would sit and see what RBS do next on the UE debt. Cabot are a bit unpredictable but yes I think I would do what you say if you are happy with that. It shows good faith on your part if they try to play rough at this point.
