      10 loans/credit cards - 3 confirmed UE, 3 recon/copy received, 3 not received a CCA reply, 1 might be enforceable

        Cheers, Hampsire boys in it together.
        Niddy have been checking out stuff and found CCA for loan with BOS, looks v enforceable, has all prescribed terms, etc. God knows why I kept it?

          Nope they cannot do that. You send payment to a particular account.... don't worry about that right now, it won't happen..... each debt is unique and identified by account number which is what you concentrate on.

          forget them as being monetary things from now on and classify them as accounts with a blanace yea? don't stress - read some of the diaries for an idea of what will happen and how I deal with it, in my unique way! ;LOL
          The concern certainly bears thinking about. It is sort of like the bank's right of offset from any balance in a current account - there appears to have been some instances where banks have plundered a current account to pay off a credit card. This has created or worsened an overdraft and more importantly has actually transferred debt to a higher interest rate. if someone went at this legally armed, I tend to think that the courts would strike it down.

          But the fact that banks have tried this on, moving debt from a credit card or a loan to an overdraft suggests to me that they could try it on to move payments from an enforceable debt to a non enforceable debt.

              Youre right in what he's saying however I read it as meaning if he was to send a cheque in clearly marked for his mortgage each month, they could not then take that and put it towards his credit card - so to speak. However, if there was the mortgage money in his bank account they could swallow that a day before the mortgage, to pay the card, and then demand the mortgage payment the day after - a lot of that has been happening. Ive not heard of many cases of clear abuse whereby a cheque sent in to pay a particular account, has been mis-spent....

                              Ahh they were there, but on the opposite side.... also, when he let jules go you seen the safety rope holding him up lol.... bear in mind we're talking 80's haha

                              still a classic film though..... as for him flying throught the sky when he

                              a) jumped from the plane into swamps at the start

                              and

                              b) doing his tarzan act in shopping centre

                              well, that is best forgotten!! Oh yea, and ripping up the phone booth - haha CONAN!

                                Agree. When I worked briefly in an organisation with customer accounts, I know that once the customer allocated the money he sent to a particular debt, this was immutable.

                                But, relying on my memory of the green place, the abuse involved any single debt and a current account. The banks were offsetting not only a credit balance but also offsetting into overdraft - thus gaining more interest.
