    2.07.10 CCA Query sent re Niddy’s advice

    4.8.10 Letter rec’d stating they have provided a copy of the agreement which complies with their obligation under the Cons credit act. Contact them to discuss the repayment to prevent further recovery action.


    4.8.10 I received a letter thanking me for my correspondance and saying for me to be aware that they have provided me with a copy of the agreement which complies with the Consumer credit act 1974 and they do not consider the a/c to be in dispute. Pls contact to avoid further recovery action.


    Wtg Niddys advice

    13.8.10 Debtors final response CCA Rec’d letter sent

    11.9.10 Statement received from Link 25.7.09 > 26.8.10

    Statement received from link 27.8.10 > 3.9.11


    Today a new letter:-


    Letter from Link stating they have obtained a telephone number that you supplied a credit provider when applying for credit. This information was supplied to us by a UK CRA. If you believe this information is incorrect then please contact our office on XYZ. In the event that you do not contact our office we will of course use all th einformation we have on your file to decide the next course of action to recover the balance in full from you.

    I changed my telephone number some time back so I assume they have been ringing the old one. Prior to changing they were on the phone all the time. My OH used to answer and they would ask for me by my first name as if we were mates.
    do we have an agreement?

    Has the sums been checked by an official program such as DualCalc?

    Does the agreement contain any PPI or charges which are incorrectly classified as credit then they are infact charges for credit?

      Hi Paul,

      Yes there's an agreement, which Niddy says is enforceable once T&C's are sent (not sent yet)

      Sorry, whats DualCalc for ?

      Going to check re the PPI

        Dualcal tells you if the figures are correct,

        Prescribed terms do not just need to be there, but also correct!!

        Without checking the APR, interest, credit, repayments, total amount payable etc, how do you know if its right

          That's what Niddy's for

          No seriously I'll have a look at dual calc

          Interestingly my customer copy of the agreement has the ppi box un-checked but the one they sent through has it ticked.

          I said I didn't want it as I was self employed.

          Anyway it's irrelevent as I didn't fill in the DD instruction for the PPI when they sent it through, so no payments were made, but shows how they try it on.

          There are lots of £30.00 late payment fees.

            Well its not quite that simple, you wont get Dual Calc i doubt as its no longer in circulation and is an Office of Fair trading program

            Its not irrelevant as if therei s a "charge for credit" which is not credit then its unenforceable End OF!!

            Thing being if they included PPI in the credit and you never had it for example, then they are shafted

            as to what is a charge for credit you need to go to the total charge for credit regulations , regulation 4 and 5

            Its not just what you think is a charge, law sets its own definitions dont forget which can deviate from the common sense interpretations

                I don't have it no. Could I load it to the site or is it hot property...?

                    i wouldnt,

                    the more worrying thing would be if people used it and didnt enter the variables correctly then they would get incorrect results which would be catastrophic

                        interesting results with that.

                        I need to see the terms and conditions and also the "other" documents in your possession.

                        It seems maybe, and i emphasise "MAYBE" there may be an error in the prescribed terms, there are certainly points that need further enquiry here, as the devil is always in the detail.

                          I'm interested in your GE Money/Link loan fedupwiththeworry as I have a similar loan which Niddy at first said was UE and then said was enforceable.

                            there are some points that i need explanations from Fedup on as there are two sums suggesting to be credit and they cannot both be right

                            until Fedup gets back we wont know more

                              Haven't been around much as I've been trying to do some work and get some money in with car MOT/repairs/Xmas looming and all that.

                              I rec'd a letter from Instantsilver (who after doing a bit of research are Link by another name) offering me 50% off if I set up a payment plan over 48 months to repay the other 50%.

                              Will be ignoring this, no money available here and they are only asking for contact if I require any more info on the offer.
