20.1.11 Letter from 1st credit offering various discounts for payment
          22.1.11 Ignoring re Niddy

Latest letter received today is from Connaught Collections (in same building so assume in house collections) stating they have been instructed to recover the o/due debt and understand that I have been already furnished with the full details of their clients claim.
Please pay in full within 7 days as in the event of non settlement their client reserves the right to issue legal proceedings if neccessary which would add interest etc etc.

Athe bottom under the signature it states :
Our company has sole control of your a/c. Payment must be sent to this office, do not pay a doorstep collector without first gaining our authority...............as if.

                =Capital One

HL legal solicitors 25/08/2010 state they have limited instructions in the matter and they are not instructed to enter into correspondance. They can confirm however that they have passed a copy onto their client and anticipate that they will now contact me direct

Capquest after sending an income/exp form on the 28/08/2010 sent a further letter on 04/09/2010 saying that they were unaware there was a dispute on the a/c and are therefore closing the a/c on their system.

Cap one themselves letter rec'd 27/08/2010 saying they provided copy of current agreement on 15.7.10 and prior to that on the 8.7.10 a copy of original agreement. Also sent copy of scanned signature page of the original agreement signed by me and them. Prior to the signature I was provided with a full copy of t&c’s to keep and were sent a further copy of the original agreement with the 1st credit card. They have therefore complied with their obligation under s78 etc etc. In Carey v HSBC providing a recon is compliant with s78, they quote some other cases then and I quote "it is clear from the above that there are no elements of your clients (clients ????) allegations that survive the decisions in McGuffick and Carey, therefore we invite your client to discontinue with any further action in respect of this matter to avoid both parties unnecessary costs. etc etc They will continue to pursue the o/s debt and defend any action etc. End with financial regulations require them to advise that this is there final response etc.

Do you need to see the letter Niddy or do I just ignore them as its their final response ?
=You ignore this for the time being, all you were doing was fending off the threat of legal action from the others lol - that has now worked successfully.... well done.

Letter rec'd from Cap one today informing me that the a/c is no longer being dealt with by the DCA who were acting on their behalf. A/C has now been returned to Cap one it is important that I continue to make payments etc etc.

                        Hi Niddy,
Ignored the above letter on your advice.

New letter from Connaught today stating that as they are yet to receive an offer of repayment or valid reason for non payment they will shortly be returning the a/c to 1st credit - MBNA with a recommendation for further action, which may include a doorstep visit and or county court proceedings.

To avoid further action I must forward payment proposals etc

Re BOS :- Whom have prev said they wouldn't seek to enforce through the courts as they couldn't find the docs, Moorcroft got involved with threats as usual so you advised as below.

Another letter from Moorcroft headed Notice of possible litigation. I need to pay or costs will be added if legal action taken etc.
This letter is dated 4th Jan which is before I sent the above letter you said to send which went on the 5th Jan
(still in network for delivery according to track and trace) so I assume I wait and see what they say to my letter ?
OK according to Royal Mail my letter sent on the 5th Jan is STILL in the network for delivery lol

Today the following from Moorcroft which arrived in an envelope with no stamp, franking, or anything-

25.2.11 Letter from Moorcroft giving last opportunity to prevent more serious action being taken is to pay £50 p/m. Unless payment rec’d by 27.2.11 they may recommend court proceedings to be commenced against me by external solicitors without further notice, affect credit rating etc.

Do I ignore assuming they have actually rec'd my prev letter ?

They do say 'may' recommend,.......so it is probably yet another scare tactic letter. Have you actually rung the PO, they are able to tell you if the letter has been delivered.
