      It's been to a couple of dca's who have been batted off but as said nothing for a couple of years other than statements. My gut is telling me to ignore as there's nothing really being threatened other than a bad record and trying to appeal to my concience. but would appreciate any other thoughts if you think that's a bad idea. It will be SB next year.

      That's a normal chaser - if it's UE and they're still in default then you don' need to respond.

      I've PM'd you as well regards the thread move request.

        10.06.2010 CCA Rec’d email’d to Niddy to check

        24.6.10 Letter rec’d saying looking into complaint

        25.6.10 Re emailed Niddy for clarification on CCA

        29.06.10 S10 Cease and Desist sent

        17.7.10 Letter rec’d acknowledging complaint stating they will investigate, bal still o/s etc etc.

        28.7.10 transaction list for a/c received.

        2.8.10 Letter rec’d apologising for delay.

        2.8.10 Ltter rec’d refuting S.10 need to send to Niddy.

        13.8.10 Debtors final response CCA rec’d letter sent

        26.8.10 Letter rec’d Moorcroft saying I have defaulted on agreement to pay £18.78 per month. So now in arrears by £18.70. Their records show dealing through a 3rd party if no longer the case contact them directly. Inless payments are maintained there’s a possibility they may recommend to their clients to instruct solicitots for legal proceedings.

        4.9.10 Letter rec’d Moorcroft saying despite letters I have defaulted , arrears now £37.48. as a result of this a/c has been passed to home collections div for action. May involve home visit etc.

        6.9.10 Threat of doorstep visit letter sent

        5.11.10 Letter from Santander apologising for the delay still looking into the situation.

        5.11.10 Letter from Santander replying to my letter dated 13.8.10. They refer me to their letter rec’d 2.8.10 (copy of letter & signed credit agreement again enclosed) and it is their belief that they have fully complied with all elements of the CCA and the agreement remains fully enforceable against me. They have no further comment to make in this matter as I have exhausted their internal complaints process. Enclosed a leaflet about the FOS in case I’m not happy.

        6.1.11 Letter from Wescot chasing payment

        12.1.11 a/c sold whilst in default of cca request to wescott

        25.1.11 Letter from Wescott ack my letter which they are investigating and they will not be in contact whilst this is happening. They will contact again when investigation is concluded.


        9.3.11 letter from Wescot today enclosing a copy of the agreement which is the same as the one's prev sent to Niddy except for the fact that it's been printed onto Santander paper so has their logo on it this time. They state that payment is now required and give the different ways available to pay and state that in certain circumstances they can agree a monthly instalment plan.

        10.3.11 cca query missing prescribed terms letter to wescot

        26.3.11 Statement 09/10>03/11 rec’d.

        23.5.11 Letter from Wescot stating that having contacted their client they have been advised the documentation I have been issued does comply with the requirements of the CCA 1974, meaning the bal is correct and remains o/s. In the circumstances they believe the dispute has been resolved and the full balance or an agreed monthly installment is req by return. You can pay by blah blah.
        If in the event you believe you still have a valid dispute, please contact us with the details within the next 14 days otherwise you’re a/c will be returned to their recovery team for collection.


        27.5.11 Refusal by lender/dca to accept ue letter to wescot

        8.6.11 Letter from Wescot stating they are investigating, collections suspended whilst under investigation. Will need to contact their client which may take some weeks.

        29.7.11.1 Letter from Sanntander refering me to their letters I rec’d 2.8.10 & 5.11.10 which they have enclosed along with a copy of the signed credit agreement I refer to.

        They state “As before, my letter confirmed that as your credit agreement is a regulated agreement for the purposes of the consumer credit legislation, it is our belief that we have fully complied with all elements of the consumer credit act and the agreement remains fully enforceable against you. As explained to you in November, we have no further comment to make in this matter and you have exhausted Santanders internal complaints process.

        Encl:-copy of letters, copy of signed credit agreement, copy statement of account.”

        Debtors final response CCA rec;d letter was sent in response to the 2.8.10 letter and 5.11.10 letter was ignored.

        13.11.14 Letter from Santander with a notice of assignment attached. Bal of £6385.63 sold to Hoists Portfolio Holding 2 Ltd on 15.10.14. NOI is from Hoists who have appointed RobWay to manage a/c and all future payments to go to them. I should contact them as a matter of urgency to organise payment.

        14.11.14 Letter from Robway wanting to assist me pay off the debt

        14.11.14 A/c sold whilst in dispute to Robway (del 17.11.14 signed Prescott)

        27.11.14 Letter from robway “what am I able to pay” set up plan poss reduction etc

        29.11.14 Letter from Robway “foll my request they have asked for a copy of the agreement to verify that I am liable to pay, a/c placed on temp hold pending receipt of the documentation.

        14.1.15 Letter from Robway “pls note we have not yet rec’d a response from the orig creditor. Seeking an update and a/c remains on temp hold.

        26.2.15 Letter from robway still waiting for response from orig creditor

        10.4.15 Letter from robway dated 6.4.15 still wtg info, so a/c still on temp hold

        12.8.15 Statement 8.815 > 1.8.15 o/s bal £6385.63 rec’d from Hoists

        Today a letter from robway with the "requested documents and pls complete financial statement and confirm payment proposal" The "requested docs" are exactly the same as rec'd before interestingly on this version after the last payment Santander had added "Write Off".

        There's also the added bonus of the signed application form from a joint account I once had with santander thrown in for good measure

        Advice on what to do appreciated. They are putting the a/c on hold until 18th for me to reply

              Well robway have sent me a letter telling me they understand it can be a struggle maintaining payments to debts and I may have had a prev agreement I was unable to maintain etc, please contact to discuss the situation....All this seemingly ignoring my MPT letter sent in Nov.

              Assume this should be ignored ?

                  No threats, quite polite really, just me being paranoid as usual so wondered if they were setting some sort of paper trail..."look judge we asked ever so nicely" prefer to ignore though if that's ok less hassle this close to Xmas

                          Last letter was ignored as advised.
                          Another one from Robs today headed "help available" stating they've sent a number of letters but a/c remains unpaid. They want to help set up an affordable repayment or can maybe agree a reduction. Call to discuss.

                          Still ignoring my MPT letter and no threats so assume I ignore ?

                              Ignored the above and had another identical letter in March which was also ignored.

                              Today I've received a letter stating " We have not written for some time as they had to locate my address and they would like me to contact to confirm my intentions regarding the o/s bal on a/c"

                              My last payment to the DMP was 22.4.10 and according to them this was paid on the 26.04.10

                              Assuming I should continue to ignore as so close to SB ?
