    I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. I am extremely busy so if you do contact me or need a reply to a forum post then use the email or PM features offered because I do miss things and get tied up for days at a time!

      Hi NID, I received 2 letters today.

      The first one was from Power2Contact chasing a Barclaycard debt on behalf of Mercers, I wanted to get something off quickly to this lot so I sent the letter sold whilst in dispute with the threat of doorstep collection tagged on the end, was that right?

      I seem to remember you giving someone else similar advice to that.

      The other one was from Albion chasing for Halifax and they are still claiming that I'm ignoring them even though I sent the letter sold whist in default over 3 weeks ago, should I resend or ignore?

        I sent something similar to power2contact back in July and haven't heard anything from them since.

          Evening NID, I received 2 more letters today.

          The first one was from Calders on behalf of Barclaycard offering me a discount of 40% if I want to pay the balance off in full, funnily enough it's the same account that P2C are threatening to come around and collect on, isn't it against the rules to have 2 DCA's chasing you at the same time?

          Also received a letter from P2C on behalf of Halifax, they say that if I don't ring Halifax in 3 days then they will send someone around, not to collect on the debt but to help establish contact again even though I've already sent Halifax a letter about door step collection.

          The annoying thing is the last contact with Halifax was me writing a letter to them which they chose to ignore.

          What do you think I should do about this one?

            send power NOT 2 contact the account sold letter and a copy of what you last sent to HBOS and remind them it'd be in their interests to return the account to the lender......

            Regards Barclays - fook em, same old same old with those muppets! They can send 5 DCA's out at the same time if they want, so long as they have partially assigned the debt - i'd not worry too much about this, some DCA's are overrun with work (bless em) so things sit for like 8 weeks lol. Could be a natural delay from one to the other!

              Afternoon NID.

              I got those letters off to Power2Contact after and nobody turned up, I also included the last letters that I sent both Halifax and Albion that they didn't reply to either, anyway I received another letter from Albion today urging me to contact them to avoid legal action and a debt collector visiting me for payment which will bring more expense to me etc, the usual threats.

              Should I ignore or should I send the threat-o-gram letter?

                I'd start to ignore them now, they clearly do not grasp their legal obligations so seriously - fook em! ;LOL

                    Haha - mate, even I don't want you to ring me - lol, you're probably one of the main guys on here that knows the most legal jargon (i.e. cos you've been here so long now - you know the process pretty much already!) so it'd be funny to hear if they happened *to sneak through* to you, via your tru-call; your ex directory and blocked number with guard dragons and a witch at the gates....

                      The only chance they've got of getting me at home is if there's a power cut! They can still get me at work but I'll make out the call is being recorded and throw some random rules from the OFT regs at them to try and confuse the phone monkeys. ;LOL

                          Hi NID.

                          I came home today to find a hand delivered envelope pushed through the door from Power2Contact where they've been around to visit! ;EEK

                          It contains a card with a reference number and a mobile number to call telling me to call in the next 24 hours to stop further action.

                          What do you think I should do? Call it and explain that it's in dispute and that I've sent a letter saying that any visit would be seen as trespassing or should I ignore and wait for them to come again?

                            I'd call it and tell him - that will be the visiting officers number so may work - if he tried to bully you then tell him you're recording the call and formally reminding him any visit will be trespass and the police will be called with no prior notice, for his removal. 1 1

                              Well I called him, I basically told him that I wasn't sure why he was calling as I'd previously wrote to Power2Contact explaining the situation which included letters for them to pass on as well as saying that any visit from them would be seen as trespass, he tried telling me the law and that he was allowed to come around as the police are not interested in trespass to which I told him the OFT rules say that once I tell him to leave my property that he has to go, so any other visit would be a waste of time as I would tell him where to go without getting into a conversation about it.

                              He then said he would tell Halifax and Barclaycard what I'd said but he couldn't guarantee nobody else would call, I told him they would be wasting their time like he had and then he ended the call.

                              Today I've received a letter from Calders for that account so it looks like it's been passed on to them instead.

                                Well done you - knew you'd cope and you were spot on telling him the ACTUAL law - muppet! For the record, in civil cases it would be trespass but in the respect of playing the legal game with them you'd hide behind regulations meaning if they break it they can get done harder by the governing bodies - saves you going to court for a silly trespass claim. Point is they are more scared when you quote relevant law to them than civil law cos hardly anyone follows it through.......
