    Hi NID, as you can tell by the date of the last post in my diary the letters are getting fewer now and some of them have been quiet for months, however I'm dealing with Wescot at the moment and I could do with some advice on how to get rid of them.

    To bring you up to date they sent me a letter saying they had been instructed to collect on the debt which I replied with the sold whilst in dispute letter, from there they've sent me a copy of every statement since 2003 for the account and also a separate letter saying they have contacted their client and been advised by them that I send another copy of my original CCA request letter.

    Should I just send it off or give them the brush off?

    What do you think?

      You should note Wescott only buy dubious debts, ie chances are it aint gonna be enforceable if they even have a copy at all.

      Can you remind me the status of the account, ie have they sent a CCA (ever) and if so was it en or ue?

      For moment, don't do anything.....

        Hi Locke,

        I'd await Niddy's response on the exact reply but I can tell you that this is rapidly becoming a standard tactic with Wescot. All of our cases with Barclaycard are handled by solicitors but out of the blue having received two of my special "bugger-off" letters they sent 6 years worth of statements for one account in one large envelope and a copy of a microfiched application in another small envelope. No letter nothing. The "application form" had been declared unenforceable nearly two years ago by sols and BC had been told to go to court if they thought they had a case. Hence I believe its a try on by the Hull Heroes as a new tactic to get you to contact them.

        So 16 bunches of parasitic lowlife like Wescots later they produce more stuff to keep our recycling plants open.

          Thanks for the speedy reply.

          The status of the account was that it's unenforceable and has been for over a year now, they did send what they claimed was a CCA but it was the standard recon application with terms they need to make it enforceable placed on the back smack bang in the centre.

          I can copy it again if you want to have another look?

            Thanks Garlok.

            It's reassuring to know that it's a standard tactic from Wescot as it did make me scratch my head when it arrived on my doorstep, I can usually handle most things now due to the experiences I've been though since I started down this route but it's occasions like this I rely on Niddy to help me out.

              Nah, no need to see it again matey. Basically for argument sake, send this back to Lowell CCA Query - Creditor Refusal to Accept UE Status

                    One of my debts have been sold on to a company called MKDP LLP, they seem to be a new company with little information about them available but good luck to them if they think they're going to get me, especially after Barclaycard have admitted they don't have a CCA for the account!

                      I Know your an old boy here,,,, and you know what you'r doing, have you sent this > CCA Query - Letter Previously Confirming No CCA
                      with a copy of that letter you have

                        No not yet, I'll let them come after me and waste some of their time and money first.

                        I should have explained it better in the last post that it was Barclaycard that wrote and told me they had sold it on and I've not heard anything from this new lot yet.

                          But if Barclays had already sent a "we don't have an agreement" then you ought to send that letter to the new debt owner, not back to them as they'll just say "we can still chase an UE debt - which we know they can)!!

                            Hi NID, hope you are well?

                            So I followed your advice and got this letter sent off to Wescott, I've not heard from them since but received a letter then other day from some solicitors supposedly acting after Wescott passed the debt on to them for collection, it's just the usual threats about how other forms of collection 'may' be made etc.

                            Should I send them the letter too or just ignore it?

                              This wouldn't be "Nelson Guest and Partners" would it?

                              If it is they are the toothless tigers renting their letterhead to Wescot (The Hull Heroes). If you look around that letter and check the small print about payment you will find that the numbers will tally with those of HH's.

                              We had slightly differing circumstances but we threatened them with action and complaint for breaching the SRA code of conduct on several counts. The alleged account was back in Hull the same day as they signed for the recorded delivery.

                              I would consider sending them a copy of the previous letter and this one:

                                Just wanted to say thanks for this tip, I'm just starting on my UE journey and want to control the phone to stop stuff like this.

                                I've switched all the ringers off so that when a call comes through the displays just light up with the incoming number, and the answer machine is switched off so any messages go to BT's 1571 service. My phones allow call blocking too!

                                Good to see that one year on your journey is going positively. The letter ping-pong must be a pain but the outcome for you looks good so far! My fingers are crossed!
