    Today I got this letter:-

    Notice of Assignment

    This letter is to give you notice that on 30/11/2011 Bank of Scotland Credit Card has assigned all of the rights, title and interest in your debt to Wescot SPV Ltd (Wescot) The above debt is now legally owned by Wescot and has been passed to Westcot Credit Services Ltd for collection.

    This debt has been sold to Westcot as you have failed to repay, or reach a satisfactory payment arrangement with the original creditor, As Wescot now wns the rights and title of this debt we will take the necessary action to recove payment of the outstanding balance.

    You will be contacted shortly in relation to recovering this outstanding value.

    If you have any concerns regarding the future conduct of the account, or if you have a genuine reason to dispute the debt, you should contact us as soon as possible.

    I have sent the Account Sold whilst in Dispute Letter so I will keep you updated with what happens next .............

      I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website.         Now this is getting kinda scary....

        Today i received this letter after sending the Account Sold whilst in Dispute Letter.....

        Despite a number of request for payment, you have failed to agree and maintain an acceptable repayment plan on the above account. Therefore, this matter has been referred to our legal department with a view to raising court action against you. It is in your best interest to settle this account prior to the commencement of legal proceeings and you should contact us on 0844 824 1158 on receipt of this letter to agree repayment. Alternatively, write to Wescot at the above address or email legal@wescot.co.uk

        If you require independent advice on the management of your finances, you can obtain fress advice from such organisations as Citizens Advice Bureau, CCCS, National Debtline or any other similar organisation.

        You should not ignore this letter as a failure to act may result in a court decree being granted against you.

        Payments can be made via the following methods...............

        We hope further action will be unnecessary. Please contact Wescot or send payment for the outstanding balance within the next 7 days.

          As FlowerPower says, this is standard practice from these people. I also have a file full of bright red letters!

          Just chill and follow the advice, this one letter won't change anything.

            They sent me lots of letters like that last year, bright red to make them even scarier! They are all computer generated templates sent out by the dozen! A year on, I have yet to see any sign of legal action.


            Should I email the legal department or just ignore??

            To make it go away i was going to consider Debt Arrangement Scheme (DAS) however I have stuck this out since 2008.

              is it unenforceable?

              if its been going since 2008 you could be just over a year away from it being statute barred, a DAS is quite restrictive and all the debt would need to go in.

              Hang in there, its really not at that stage yet and it might never get there.

                Hello m-m-m!
                Are you sure this one is in direct response to your Account Sold in Dispute letter? Looking at the wording of what they've sent, it sounds like a standard Mailsort-type bulk mail threatening letter spat out by a computer (I believe they have an "s" and a weird circle/ring symbol on them on the envelope where the stamp would be). Proper responses to a letter like that would usually (but not always) have a pre-printed 1st or 2nd class thing on it, or be franked with a franking machine.

                If you check the date they received your Sold in Dispute letter from your Post Office recorded receipt, and then check the date on the letter received today, it's likely that your letters crossed in the post and they have yet to respond to your actual letter! That letter really doesn't sound like the usual type of reply a Niddy letter provokes! :niddy

                        Had a look at the envelope for the letter I got yesterday and it defo looked like a mail shot.

                          Please note that this account has now been transferred to Wescot's Advice Agency Support Unit, and we expect to provide a response to your query within the next 7 days.
