        I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website.                         Owned by 1st Credit
                        Cca sent by Yuil & Kyle solicitors March 2012, wrote 1st Credit an angry letter about it and never heard from them since. Basically pointed out that the 2 signatures on the agreement were completely different and clearly not done by the same person ie me. Also pointed out that on the agreement it states a £50 courier fee will be collected on payment month 3, on statement of account there was no £50 fee added or taken separately - will email Niddy so that he can have a look.

                        26/11/13 Received phone call from Bank of Scotland customer Service - caught me off guard I never normally answer the phone. They were calling to answer any queries I have with the above agreement. Didn't have a clue what to say I just rambled on like an idiot. I mentioned that the signatures on the agreement are completely different as if signed by 2 different people, the date signed predates he agreement date by 1 year, and also about the fact it was delivered by courier. She said they do not keep records about who the courier would have been, as I queried if the courier would have signed it and that's why signatures where different( I must've sounded like a right idiot) I asked why she was calling on behalf of 1st Credit as it's owned by them but said it's just a courtesy thing. I never mentioned anything about enforceability, but she advised me to go to the ombudsman if I think it isn't. Kept asking me if I remember taking the loan out, and I can't deny that the loan was mine but said I don't know! Said she'll send me another copy of the agreement out and to give her a call if I've any problems with it.
                        Wonder if 1st Credit are trying to pass it back to them or if they are now going to up their game!
                        How can I handle this better if they do contact me again?

                              30/11/13 - Letter received from HBOS - Further to our telephone call blah blah, they cannot explain why the dates are incorrect, but they are happy the the procedures they had in place when the loan was taken out. They believe the loan is enforceable and I should now contact 1st Credit or complain to the ombudsman.
                              Niddy looked at the agreement while ago and it is all there and correct, apart from the bit in the t&cs explaining about how it will be delivered by courier and the fees. I wasn't sure at first if it was delivered by courier as I thought I signed for it in branch, but looking through the info in my SAR it was courier delivered. Niddy mentioned if it was delivered by courier it could be UE. HBOS have made no reference in their letter about the courier despite detailing everything else that was said! My recollection of previous loans being delivered by courier is they turn up ask you to sign then take it away (HBOS also confirmed this on phone, it would have been signed and taken away for signature to be verified) then funds where deposited into my current account.
                              Not sure what to do with this now, as I had a legal threat from Yuil & Kyle back in March could they proceed with it again without further correspondence? Any ideas for a letter I could write to HBOS advising that it is UE because it was delivered by courier and explaining why - could also be why I don't remember signing it!

                                I worked for a short time at a call centre for BOS arranging loans over the phone, my recolection is that we filled the aplication in over the phone, if approved a date and time for a courier to attend your address was agreed, they brought the papers asked for identification [ passport etc], once signed and courier has seen proof identity , the courier phones a number and gives the loan agreement number, presto, the money is deposited into your account
                                they were nearly all sold as *no payments for 3 months* they forgot to tell you that interest was charged from when you sign for it.
