    20/01/14 - Missing Prescribed Terms letter sent
    27/01/14 - Letter received requesting payment and that they know of no valid reason for why I haven't made a payment. Would like me to contact them to avoid further action from bring taken.

    Eh? I thought they'd done that! They quite clearly do not read their incoming mail and it's just a lucky draw of what template they'll send out next! Anyhow I'll be filing & ignoring this.

    22/03/14 - Response received in regards to missing PT letter - "Please be advised that the Lowell group of companies at the point of purchase are assigned all the rights and benefits assoc with the acc but we do not hold copies of the agreements within our offices. Therefore we cannot provide you with any info regarding the agreement. HBOS plc however have already provided you with a copy of your signed agreement which included start date and to which a credit facility was extended to you, copy statements have also been provided to evidence credit used under this facility. The processes and procedures of Cap one (really I thought this was a HBOS card?) would not have allowed any credit facility to have been opened or utilised if they had not received a signed agreement. This agreement is fully enforceable, we require you to update us within 14 days with your clients financial situation to prevent us from litigating on the account.

      you could send, final response UE CCA received template.

      that tells them, yes you've had some document,s but it doesn't fulfill your CCA request

              02/06/14 - Received what must be response to the Final Response UE letter I sent. It's being treated as a complaint and collection activity on hold.
              Happy with this response and hopefully it'll be on hold until the 29th June when it should be time barred. Last payment I made was definitely the 29th of May 2009, only thing I'm concerned about is a letter I wrote to HBOS which I discovered in a SAR. It was June 2009 the time of the bank charges changes, I wrote asking them to refund charges and cease charging interest but I never specified account numbers ( it was declined) I'm not sure if that could be seen as an acknowledgment or if Lowell would even know the letter exists, as I wouldn't have thought HBOS would have provided it.

                13/01/14 - Seems Lowell have finally realised this debt exists after hearing nothing from them over the years apart from letting me know they had instructed Debt Managers to collect the debt - and I never heard from them either! Just received standard letter, no threat what so ever, they want to help me and I can pay as little as £1 a day! Anyway I think I'll just ignore this letter for now see what the next couple of letters say before I fire off a CCA request, just to bide some more time.
                12/06/14 - Lowell have passed this to Lucas Credit Service, no real threat to their letter, they have given me 5 days to contact them.
                13/06/14 - CCA request sent, Lowell's have never actively pursued this debt so I'd be interested to see what I get to the response.

                  13/09/14 - Well it has taken them long enough (not that I'm bothered!) the conclusion to my complaint - they basically have just summarised what letters I have sent them and how they have replied, enclosed copy of agreement & statements. Account on hold for a further 30 days then collection activity will resume.

                  Now I'm pretty confident that this account is SB, last payment was defo the 29/05/09, the amount they are asking for is the same as when it was defaulted - so no phantom payments, the only thing added to the account since I stopped paying until default are charges and letter fees.

                  So.....do I ignore them....or fire off the SB letter?

                    Why are you “pretty” confident that this is SB, instead of being ABSOLUTELY confident? Do you think you may have acknowledged the alleged debt in writing at some point?

                    If you are absolutely certain that this is SB, I would sent off the SB letter. Why wait and go through any more arguments when the SB card trumps all of the others anyway?

                    Just make sure that it genuinely is SB first.

                        Received response from Lowell today in regards to the SB letter I sent for HBOS credit card.

                        They advise that as the default date was not until the end of November 2009 it is still within time limit. Collection activity on hold until they get further information from HBOS. Clutching at straws I guess.

                        Now I'm confident last payment was end of May 2009, but kind of want to nip this in the bud as I don't want another stressful Xmas!

                        Should I respond?

                          I think they have tried this with someone else on this site. they are hoping you do not know the difference between defaults and SB.
                          when the default is registered with the CRA's is totally different to when you last paid, so they are talking manure and chancing their luck.

                              This is the other instance of Clownell attempting to con an alleged debtor that there is connection between the default notice and the statute barring date -

                              In this case, if they are waiting for information, it might be better to just let them get on with it. Christmas is still two months away, so plenty of time to send SB letters.

                              It might be an interesting idea to wait until December 2014, and then ask them whether they STILL contend that the statute barring date is five years (Scotland) from the end of November 2009?

                                Hi guys been a while since I posted as not much happening really, hope you are all well. I get the odd letter from Lowell, not much threat, they just keep sending me a bunch of HBOS credit card statements in response to SB letters. The statements clearly show no payments so quite frankly I don't know why they are wasting their time. The statements range from account opening up until 2014, the question I have is, if HBOS sold this account to Lowells in July 2013 why would they still be producing statements on the account and sending them to Lowells as a response to SB letters or is this Lowells just fabricating them?
