    Re: Loopyloo UE Diary

Sorry to be a nuisance but in with my ppi refund letter from HBOS they have also included a 'previously declined claim on ppi policy application' form for me to fill in if I'm concerned that the refund they are offering is less than the amount of money I would have received if the claim was accepted. Now I did try to claim on my defaulted loan when I was unwell and lost my job, but it was declined due to a pre-existing illness.

Now I don't want to milk it and I'm quite happy with what they are refunding me, considering the amount I was in debt and have no intention of paying it back if I can't help it! But there is a little part of me that thinks that if they'd bloody paid out in the first place I wouldn't be in this mess! Prob best to grateful for what they are giving me and leave it but I was wondering if anyone else has claimed that?

Just realised this might be better posted in the ppi reclaiming threads so will post it there too.

          HBOS Credit Card
          £3500
          Opened - 15/09/2005
Last Payment - approx March 2009
          Not paying
          Owned by Lowell's
Lowells are in process of sending cca.

25/10/13 - Received letter from Lowell's advising they have contacted HBOS for copy of agreement and statement of account, and that account will be put on hold.

30/10/13 - Letter received from Lowell's stating that if I do not pay within 7 days my account will be passed on to Fredricksons for collection.

Niddys response to CCA I received as part of a SAR :

          Hence it is UE.

11/01/14 - Statements received as part of CCA request, they advised agreement should follow at some point. Niddy has previously looked at the CCA I received as part of a SAR and deemed it unenforceable so just a waiting game to see what Lowell's send. How slow are they though this was requested in October!

18/01/14 - Received CCA agreement from Lowell's, copy of the same agreement I received as part of my SAR.
20/01/14 - Missing Prescribed Terms letter sent
27/01/14 - Letter received requesting payment and that they know of no valid reason for why I haven't made a payment. Would like me to contact them to avoid further action from bring taken.

05/01/14 - Response to my Missing PT letter - they are treating it as a CCA request and are requesting the agreement from the original creditor.
Eh? I thought they'd done that! They quite clearly do not read their incoming mail and it's just a lucky draw of what template they'll send out next! Anyhow I'll be filing & ignoring this.

              Barclays Credit Card
              £2300
              Opened - 03/10/2006
              Last Payment - May 2009
Owned by Lowell's but they have also just instructed Debt Manager to collect the debt. Will cca request debt managers once I have received a couple of letters from them.
13/01/14 - Seems Lowell have finally realised this debt exists after hearing nothing from them over the years apart from letting me know they had instructed Debt Managers to collect the debt - and I never heard from them either! Just received standard letter, no threat what so ever, they want to help me and I can pay as little as £1 a day! Anyway I think I'll just ignore this letter for now see what the next couple of letters say before I fire off a CCA request, just to bide some more time.
12/06/14 - Lowell have passed this to Lucas Credit Service, no real threat to their letter, they have given me 5 days to contact them.
13/06/14 - CCA request sent, Lowell's have never actively pursued this debt so I'd be interested to see what I get to the response.

Niddys response to CCA that came with SAR - This is UE as it is clearly only half of the terms. For example, there is no terms regards the PPI that you have opted into, likewise term 7 clearly mentions "under condition 12.2" - however that is the last term, where is 12.2?

Ok so I will be sending them the Missing PT letter next week, do I need to edit it in anyway? I just wasn't sure about the part were it's asking for a true copy, I have got copy of the original. It's the original that's missing the PTs. Or am I just reading to much into it and that's the whole point of sending it, as we are arguing it can't be the original as it's missing PT?

best not to footer with these templates, you don't have the original because it is incomplete.................................or the original was incomplete from the get go...........................either way, I would just send the letter

Think this may have crossed over with my letter sent the 20th as theirs is dated the 23rd. Was thinking of just filing and ignore for now and see what they send next?

You'll find this with Lowells. The drones are only allowed to respond with standard template letters so you'll get sent the one that the single unit brain celled operative thinks best matches the circumstances. Works in your favor as it just keeps things dragging out (not to mention you can keep things dragging too by referring them back to your previous correspondence to which they haven't provided a reply) so all good!

I'm quite happy to sit back and let them drag this out .

Frustrating though as they don't turnover their millions from running their business well, as they don't have a bloody clue at times, they make their millions from bullying vulnerable people that unfortunately don't know any better.
