                Re: Differentjudge v EGG/Barclaycard

I POSTED THE LETTER TO POWER 2 CONTACT REVOKING THEIR RIGHT TO CALL AT MY HOME

They wrote back acknowledging receipt and advised that as the creditor or acting as the creditor they have every right to call.
Today they called and left a calling card

                What is my next step

                  Home Visits
Another very common scare tactic is to threaten the debtor with a home visit from a collector. Again this is harassment and should not be tolerated. The debt collector has no rights whatsoever to make a home visit unless the debtor gives permission. If a collector did turn up on a debtor’s doorstep that have no right whatsoever to gain entry. A common ploy is to telephone the debtor and inform them that a home visit has been arranged on a specific date. By agreeing to the appointment the debtor has given permission for the collector to visit. The debtor should simply say that they know the agency has no right to visit and they will report them to the OFT if they do.

                        Re: Differentjudge v EGG/Barclaycard

These people are beneath contempt. The individuals doing the visiting are self-employed and are paid according to results. They also ask anybody in the street at the time of the call what they know about you. I have seen on a SAR that they asked a neighbour who told them to do one, and they took the mobile number from his van and later a supervisor made a call to him.

I replied a week ago. Your agreement is post 04/2007 and they're claiming electronic comms act ie you applied online and utilised a tick in the box. In layman, easy to copy.

But you're on a £1pm repayment so keep to it.

Can I ask if Niddy deemed this one UE or not.

You originally stated it was 8-10 years old but then his Nidship talks about a post 2007 account as electronic coms but then says someit about a simply be account.

There will be one or two of us very interested in what you got back from Barcraps if its a pre 2005 account.
