        Ok, what do you ultimately want to happen here? Chances are they will not have a signed agreement, even if they do the odds of them actually getting anywhere by taking action are slim.

        Usually we say try and sit it out so it can reach Statute Barred stage meaning they cannot hassle you to pay (or more to the point you no longer have to pay). That is why we say cessation of payments is sometimes better than paying £1pm for eternity.

        Make sense?

        Have you sent a CCA yet? If not get one sent and let me see what they send you.

          I have a partial SAR sent 09/04, which said 'no details available' on Credit agreement.

          So I sent them a CCA request 19/04. Nothing received as yet
          , deadline passed 03/05.

          Only thing they have sent since my CCA request is that letter from Reliable above.

            ok well if there is an outstanding CCA request then you can ignore them until they comply.

              I have all my letters to them and replies, and the SAR etc all scanned, but they have all my details on, and the SAR is like 93 pages :/

                You're missing the point. s.78 is nothing to do with SAR forget the SAR. A s.78 request is totally different.

                As they are in default of the s.78 request, sit tight till they do comply. Keep us updated with any letters etc that you may receive and we'll help as and when you get hassle.

                    Just got 2 letters from them today, one I assume to be the CCA and the other another Reliable threat.

                    Love the fact the CCA was apparently written by them on the 14/05, yet the post mark on the envelope says 24/05 :/

                            Niddy is around as far as i know but these things sometimes take time. Nothing out of the ordinary.

                            Looking at your Reliable threat. Its dated 22nd May and they gave you 48 hours to stop being unacceptable to them.

                            Otherwise they will take further action.

                            Now unless I am very much mistaken 48 hours have gone by and what action have they done to you? Have you become acceptable to them? Whatever acceptable is to them.

                            Just standard tactics as they slowly lose their ability to bully you.

                              This commenced in 2011 so it is enforceable as we cannot utilise s.127(3-5) which was repealed in April 2007.

                              You could try blagging it and sending off missing PT's --> CCA Query - Missing Prescribed Terms - allaboutDEBT UK

                                Nope but Niddy does have a full time job where he works 80-100 hours a week (every week) and also runs several sites and is rebuilding them to smarten them up and resolve errors plus he's got all the legal nonsense to deal with behind the scenes plus he has over 2000 members emailing him as well as other spam on a daily basis so it can take a few days for me to get round to dealing with things - however note, if it was a claim form or urgent then you'd see - I pick up on it the same day.

                                If I don't reply it doesn't mean I've ignored you - it would likely mean in my opinion it's not top priority and thus I will get round to it later.

                                In the last hour I have just replied to no less than 62 emails dating back to 23rd May and only now have I got round to yours received 2nd June so yours is fast!

                                Patience is the key, stop worrying so much.
