My AMEX account has gone, i.e. it's dropped off my credit file as it's been at least 6 years since I defaulted, & the account is of course cancelled, but they're still sending me "statements". Funnily enough, on the "statements" they inform me that the account is cancelled, & that it's likely to be passed to a debt collection agency.
Back in 2011 I went through the 3 letter process, when AMEX started to get shirty with me, & they maintained that I was liable for the debt, but NEVER passed it to any DCA. They sent me alleged evidence of a valid contract (tick box on a web application), but nothing else of use (to them). To my knowledge, it has never been sent to any DCA since going through the 3 letter process, & I believe I argued my side of the case perfectly.
So here are my thoughts:
- the account it closed, probably written off in fact; I can't pay it if it's been written off?
- why no DCA?
- can I send back the "statements" with a "sorry mate, but this account is cancelled, essentially closed, so I can't pay it even if I wanted to, so bugger off"?
- should I hit them for the PPI?
As far as Marbles go, I've started a PPI reclaim. It's well into SB, & they NEVER responded in a timely fashion to any requests regarding their status, so they can't reactivate collection actions. And if they do, I'll start it all again, but they can't log a default, etc. as the account is well gone.
