10 January 2014 - two letters from 1st Credit arrived this week, one of them this morning dated 07 January 201. Both of this week's letters are signed by Gavin Flynn, & both threaten county court action. I shall continue to write the letters, request CCA, etc.

Send a fresh CCA request that's what I'd do......

Funnily enough, I've just drafted a new CCA request which is about to go in the mail recorded delivery.

ACTUALLY, considering that this account was put into dispute in October 2009 with the OC, & further in to serious dispute with the fist DCA, surely the letter I sent detailing "account sold whilst in dispute" should work ... ??

Balance is recorded by DCA as £4,700 + change

Current status on credit record is Satisfied, but has been passed to DCA despite being in dispute since October 2009. No CCA forthcoming, despite Section 78 request & DSAR. DCAs previously assigned are Moorcroft & Westcot, now in the hands of Arrow Global Guernsey Ltd., who have recorded a default on my credit file, PLUS opened a credit account with their own reference number in my name without informing me.

              From October 2009 - February 2012
As above with the "debt elimination company". This is an old Abbey National credit card, but no-one can furnish me with any information. MBNA have even had their parent company, Bank Of America, send me letters, but I've told them to "prove it or go away!" They can't prove it; no CCA is available, & I have a letter to state that from MBNA & Arrow Global Guernsey Ltd. The default notice I received recently is dated June 2010.

30 September 2012 - letter sent stating that this cannot be enforced, inc. copies of MBNA "no CCA" letter; awaiting response.
18 October 2012 - letter received from Arrow Global stating that they are entitled to register the alleged debt on my credit file, despite not being able to produce any paperwork. Seems like a standard "you must pay" letter, but they will graciously put any action on hold at the moment. They can, however, repeat their request for me to pay up, & they can take me to court if they feel the need to.
Can someone answer me this ... there is no CCA available, letter from MBNA to confirm. Arrow Global. however, insist that the debt remains valid. I've not contacted them since the above, so is it worth a shot now with another "leer confirming no CCA"? Can hey legally leave this open until it becomes statute barred? I mean, that's just a buggeration & they're flouting the law.

Yes they can repeatedly ask for you to pay up just the same as you will repeatedly ignore that request (because thats all it is). They can' unfortunately, also report the conduct of the account to the CRA's. It sucks, you can argue the ethics of it, but unfortunately legal precedence is against you. If you want to give them second thoughts about chancing a court claim you can just repeat that they have not complied with your CCA request and send a 'final response' letter:

                  http://www.all-about-debt.co.uk/old/...o-cca-received

That way if they made a poor decision to make a claim you have a nice paper trail that the AAD preferred solicitor would use to make mince meat of them.

As above, a new CCA request is now winging its way to 1st Credit, including the postal order. Let's see what comes of it ...

BUT ... what I forgot to mention is that they had been calling the mobile & home 'phone even though in my first response letter I told them I didn't deal with things on the 'phone, & I don't respond to their SMS messages. They have stopped with the calls, SMS & e-mails which, in their words, demand a response. Small steps, little victories. Eh?

09 October 2012 - letter has been drafted stating that they hold no valid CCA, & despite requests for proof, none has been forthcoming. Settlement deal is being rejected.
13 November 2012 - Amex has sent me a stack of paperwork, copied documents from the previous "agent" ... they're saying they've checked & double-checked the documents, but are not upholding my "complaint". I didn't complain, I merely asked for proof. What I've received is an unsigned CCA, & I'm told that I would have electronically signed it by clicking a tick box on the site, which is tantamout to me agreeing. I've never signed anything with Amex ... I will be sending a letter in response, but which one?
27 December 2012 - Amex sent me a settlement deal. Duly ignored.
13 March 2014 - Amex called house & mobile numbers, despite previous letters advising them not to.
14 March 2014 - Amex sent me a settlement deal, 60% off. Duly ignored.
16 March 2014 - Amex attempt two contacts after 2000hrs (yes, on a Sunday) via international telephone.
