    Hello,

    I’ve just received a CCA I requested over a year ago. Please can someone check it? I’ll email the doc to the webmaster address. Here’s my diary for more context. Thanks v much in advance!

      06/2021 - passed to legal dept

      06/2021 - letter of claim received

      06/2021 - CCA requested

      11/2021 - Tesco confirm they are currently unable to provide CCA. Collections suspended. Intrum offer to settle for 30%.

      04/2022 - I offer to settle for 7.5%. Intrum counter with 50% and confirm account is unenforceable.

          If you haven't made any payments at all since 2018, it's a pity that you have been making offers in the current year. Statute Bar clock has been reset.

              I’ve actually contacted them a few times over the years (with offers, SOAs, to request breathing space etc.) but I couldn’t remember the dates so I left it out the history. I know it’s not the AAD way but I’ve only just found this fantastic site and was (still am) hoping to settle for a low amount.

                  Only the offer letters were headed without prejudice. I’m not sure if the breathing space one had that heading.

I know it’s not the AAD way but I’ve only just found this fantastic site and was (still am) hoping to settle for a low amount.

                    Hi, can I ask why you want to settle for a low ammount?
                    The defaults will remain on your Credit file if you pay them off or not, knowing Intrum, they will mark as "partialy settled" if you pay it off.

                    You also know that the defaults will remain for 6 years ( 5 Scotland) and then come off your file, even if the debt is not cleared, they cannot be defaulted again.

                      Additionally, on one account they say they can't currently provide the agreement. Unenforceable until they do.

                        I hope to settle my enforceable debts to avoid getting a CCJ. I have a couple
                        other debts (overdrafts) which I haven’t listed yet. And one of the Intrum debts above is potentially enforceable.

                        I just read the Intrum thread - does it mean Intrum CCJs are unlikely to go through because they’re not properly authorised?

                          Intrum, MAY TRY to go through with it, doesn't mean they will.
                          it is not possable to work out what they will or won't do.

                          You have , by keep communicating with them, let them know you are worried about A CCJ, you have also let them know you are willing to pay them anything to get them off your back.
                          sit on your hand's, stop scratching the itch to communicate with them, let them think you have nothing to fear from them,

                          If they are unenforceable they CANNOT go to court and win, unless you say "oh yea, it's mine ", Why pay out on something they can't claim on. You could put that money towards paying off the enforceable one if need be.
                          the enforceable one, you can argue about right up untill they decide to issue court papers, THEN, you can come to an arrangement to pay it off,
                          they may write with a reduced offer to not go to court, depends if it is a worth while ammount.

                          If you get the urge to contact them, come on here instead see what us , "been there, done that, wrote the book, done the tour, have the t-shirt, own the film rights", people can talk you through.

                          If we don't reply, message one of us, sometimes our lives get messy.

                            OVERDRAFTS
                            Create a Diary and LIST these.
                            Understand that Overdrafts (I presume current accounts) are subject to CCA and sending a S.78 plus £1 (AAD template) is appropriate.
                            However before doing this PLEASE PLEASE create Diary Entries.
                            We all understand the urge to do something , get rid of the debts etc.. Nobody understands this better than the DCA's!

                              Could I just add that even though an agreement may be enforceable, it can still be successfully defended, although this does require complex legal arguments. On the issue of FCA authorisation, claimants argue that they are exempt. This is a very technical argument, but there are equally complex counter-arguments. It is not uncommon to spend three hours in court arguing this very point. Because these cases are heard in the county courts, the decisions we have won are not binding on other judges.
