    Hi All,

    I have been reading with great interest and how helpful it has been. It's made me question a lot of what I have been doing in dealing with my debts, so thought it would be helpful if I laid out my debts and kept a diary on my progress.
    I entered a DMP with StepChange in June 2019, and pay around £680 in total each month with 6 years remaining. Whilst StepChange have been a great help I am thinking of going DIY with a view next year with the help of family to offer F&F settlements, my 'alleged' debts are as follows:

    Debt 1
    • Type of account - Loan
    • Date commenced - 2017
    • Approx balance - £22,000*
    • Date last 'full' payment - Jun 2019
    • Arrangement - DMP
    • Status - defaulted (account removed from credit file Sept 2021, just spotted Intrum have done a hard search on my file Aug 2021)
    • Account owner - Intrum (previously Tesco)
    *I believe all interest was added to the account when I entered my DMP

    CCA Letter request sent 25/09/21

    Debt 2
    • Type of account - Credit Card
    • Date commenced - Jun 2017
    • Approx balance - £7,000
    • Date last 'full' payment - Jun 2019
    • Arrangement - DMP
    • Status - defaulted (Equifax shows as account closed Sept 2020 and £0)
    • Account owner - HSBC
    CCA Letter request sent 25/09/21

    Debt 3
    • Type of account - Credit Card
    • Date commenced -July 2017
    • Approx balance - £6,500
    • Date last 'full' payment - Jun 2019
    • Arrangement - DMP
    • Status - defaulted July 2019
    • Account owner - PRA Group (Previously Barclaycard)
    CCA Letter request sent 25/09/21

    Debt 4
    • Type of account - Credit Card
    • Date commenced - March 2018
    • Approx balance - £4,000
    • Date last 'full' payment - Jun 2019
    • Arrangement -DMP
    • Status - Missed payments/ Arrangement to Pay**
    • Account owner - Yorkshire/Clyesdale Bank (now Virgin Money)
    **I have complained and asked them to default my account to around the start of my DMP they have refused. I am awaiting a response from the FOS regarding my complaint for not defaulting me, which puts me in a worse position than someone who hadn't paid.

    • Type of account - Credit Card
    • Date commenced - March 2016
    • Approx balance - £2,000
    • Date last 'full' payment - Jun 2019
    • Arrangement - DMP
    • Status - defaulted (account not shown on credit files)
    • Account owner - Arrow (Previously Vanquish)
    CCA Letter request sent 25/09/21

    I'll continue to read up some more on self managed debt plans, as well as CCA'ing all of the above. I read that you don't sign the request letter, why is that?

    Any comments welcome on the above...

      A default notice is normally sent when you've missed or paid less than the full amount for three to six months. Default notices only apply to debts regulated by the Consumer Credit Act. These include credit and store cards, payday loans, personal loans and hire purchase.

        Thanks for that, I'm considering stopping my DMP and going self managed which I hope stopping payments to Virgin for a while will prompt a default.

          These various `approved` DMP firms are linked to DCA's and Original Debtors!
          Its important to understand that a DCA can still sue irrespective of a agreement.
          There is more to UE than just the S.77/78 CCA. So this is where good record keeping and a Diary can be so important. The small details can be crucially important. All the time you are paying you are restarting the Statute Bar Clock! But other considerations become important such as whether the Debt is still being reported on Credit Reports! Simply put does the Debt impact on your Credit Rating or has it fallen off?
          AAD seeks to use knowledge and Law (current) so that you can understand and decide on your options rather than the DCA's running your Life!

            Another point to bear in mind is that all the time you are making payments, whether via Stepchange or a self managed payment arrangement, the chance of getting a significant reduction for a F&F settlement will be pretty low, in my opinion. They tend to become more amenable to the idea of offering reduced settlement terms when they meet resistance to paying over the longer term.

              Stepchange , like so many of these helpful 'charities' like drinkaware get most of not all of their money from the industries they claim to support people with. The businesses write it off against tax, tell the regulators'look aren't we being good helping people' and basically continue to abuse people. So alcoholics become responsible drinkers- is there such a thing? Gamblers become responsible gamblers - again is there such a thing and people drowning in debt pay back a lot of what they owe.

              David Nutt writes very well on the alcohol industry- did you know in Victorian times they wanted to ban caffeine because it is dangerous and addictive? Pot is arguably less dangerous than alcohol yet we lock people up for dealing in it, why not regulate it? ( I am not saying it doesn't cause psychosis but maybe its less dangerous than tobacco or alcohol)

                Thanks all, I had suspected I may encounter some resistance to F&Fs particularly whilst I’m making a reasonable monthly payment.

                I can foresee some difficulties or changes in my circumstances in the near future.
