I spoke to someone at the end of the phone who told me they charge 20% of remaining balances to negotiate but that it would be cheaper to do it on my own. It was just too much so I just carried on paying the monthly fee which is less than half my monthly payments. I pay them £58 each month including their fee to sort the payments out but that’s all they do.
I have looked at the template letters - thankyou to both Cymruambyth and Timewilltell for your contact. I have looked at the template letters which may be usable but without any creditor threats, I think will have to be altered. Unless I have looked at the wrong ones. I don’t know what “sticky” closed means.

Hi, it is all confusing when you aren’t sure what to do and don’t want to make any errors. Closed means that no one can post in the thread. Sticky refers to posts that should be read for guidance on the subject. In this instance there are a selection of template letters that should be used. Do not alter them other than to add your details as they have been written under the guidance of a solicitor who specialises in consumer credit law.

Hi - thanks Di and Cymruambyth. I cannot remember if I signed anything. Sorry but my memory is not good these days, neither is my filing! And, yes they do want the 20% to negotiate settlement. The previous company I believe, charged 5%.

Can I ask a few more questions please? I have been reading threads on the site and have CCA requests for 4 (the sold-on ones) of the debts ready to send with the £1 fee. The main concern I have is that the M & S one is clearly owned by them and they send out monthly statements to me despite me paying through a management company. Will sending a CCA request to them invite them to ask for full payment? Also the 2 Barclaycard Collections are owned by themselves? I have been stressing (and procrastinating) over these since last week. Just wondering if it would be better to try a low offer to settle to M & S as this is he largest one I have and don’t want to upset the balance? Sorry, I’m not the best with these things. The only other one I get periodic statements from is Link.

Please try not to worry and fret, post here and we will try to answer any questions. I would send CCAs to everyone as you will have a better idea on the best way forward when you get their replies.

I didn’t send requests to 2 creditors, 1 of which was M&S because they were nice and didn’t cause any problems; those companies were the last to be dealt with and I wish I had acted earlier. I tried a low settlement with M&S and they refused.

Without wishing to give false hope Barclaycard are known to have had very poor record keeping in the past and a lot of their agreements are unenforceable because they are unable to supply any paperwork.

Thankyou. I have been wondering about the anti tamper strip which shows through with AAD above where I type name. Is this normal?

            I will PM you also.

A question please if you could help before I go any further? Just checking reference the 2 Barclay cc and loan debts if there would be any connection to the card hubby gave me on his account and it possibly causing problems?

Are you registered to see your credit file? Such as credit karma?

No - but have been checking through the Karma site and others since your post. Will a soft search reveal old cc’s etc going back approx 20 years or will I need to use Experian or another one to do a full search? The DM company I was with a few years ago actually checked my file when they checked if I was eligible for any PPI refunds.

Any credit reference agency will only have records for last six years, if it’s not on there then it’s already dropped off your file. Credit Karma will give you access to your full report as it stands.

I have signed up to Credit Karma but cannot go any further as our old address that the debts are under is not on their drop down list. I have checked the help and it says to add the address to Royal Mail website but as the business no longer exists, (premises were changed to a house name when business ceased trading) I can’t reinstate that address. The mail has always got through and the cc’s etc were no longer usable so I never bothered changing it. Should I use our house name to search (same premises so postcode hasn’t changed). Would this show entries or should I try another company.

i was in a DMP with a debt management company (pre 2002) before it passed over to a new one last year. My has son offered me upto £3,000 if this will clear my debts due to my stress (and age)

i did ask the new company if they could try for a full and final settlement for me but they wanted 20% of my remaining balances. I cannot afford to do this and feel I must try to sort this out on my own. I do not to go bankrupt or have any CCJ’s against me. Outstanding is approximately £13,760 with 7 creditors. M & S being the biggest at £5,500. Not totally sure how this works but do I list the creditors and amounts?

                              Hello Delta1

Did you send CCA Requests to all of your creditors as planned?

If so post up the responses, and if you've received any credit agreements you can email them to webmaster@all-about-debt.co.uk for his opinion on whether they are enforceable or not.

Looking back through your thread it seems that most of them are still with the original creditor or have any of them been assigned to a debt purchaser since you last posted?

I look forward to helping you with the next stage.

                              Di
