        Not sure if this is the right place, but with regards to the CC debts my partner has in dispute with Barclaycard and HSBC, can she claim PPI mis-selling? Both debts are in formal dispute so would claiming PPI mis-selling jepodise her position with the unenforceability route?

        Sorry if this obvious and thanks for the advise in advance

          It's pointless claiming PPI if your 2 cards are unenforable has they would just take it off the balance of the 2 cards

            Yup - my OH is in a similar position. We have a potential claim of about £500 but the debt balance is about £2500 so unless they start court action we're keeping quiet.

            I guess itmight be different if the amount of PPI vastly outweighed any debt???

              Thanks for the replies. I guess that gets to the numb of it. My gf has been paying 'payment break' insurance since the card started in 2001. It was apparently to assist at times of redundancy. She was actually made redundant in 2003 but never understood she could claim nor was she ever advised that she could!! She actually carried on paying the redundancy premium whilst being redundant!! Clear PPI mis selling to me. The amount she could claim would be greater than the debt outstanding so would wipe the debt out. But i guess there is always the chance she may not win and that may compromise her enforceability stance. Hmmmm

                Have a look on the PPI Reclaim forums on here...http://forums.all-about-debt.co.uk/f...play.php?f=194 if the amount she could claim is more than the debt and she has a good case it might well be worth having a go? (You claim interest too so that can add quite a bit). See what Niddy thinks.

                  You need to visit here and start a new thread about this, and then do the reclaim - Di30 will be along to help you once you post the original thread - forget the fact they are if you take this route - start with the Advanced SAR - however bear in mind that only goes back 6yrs so YOU need to provide all the details and work out a calculation based on knowledge or your own records, you'll see - its not that easy when it's so old!

                    Okay so back to HSBC debt. Niddy previously confirmed unenforceable. Yay.
                    Have now received letter from Metropolitan collection advising they are acting on behalf of HSBC. I assume they are going to start hassling, so my question is, do I ignore or write to them stating that the account is in dispute and they should refer back to HSBC. If the latter, is there a template to follow.
                    Niddy- do you need to see the letter?

                              Well hello again after such a long time. Just when we were getting close to the 6 year period we have had a copy of a claim form lodged with the county court business centre from the claimant Hoist Portfolio holding 2 Ltd. This all refers to a Barclaycard debt that Niddy advised was unenforceable back in November 2010. In a nutshell we have a letter from Barclaycard stating that they are unable to provide details requested under the SAR and agree that their debt is unenforceable. Any advice on what are next moves are. Thanks in advance
