        Looks like I have my monthly mailshot from Cabot - they want to understand my financial situation, it must be difficult blah blah.

            This is an odd one. Today I get a letter from Santander, with a cheque (for a small amount of money - not going to be paying the rent or anything with it!), for a refund of 'interest that was calculated incorrectly when using my debit card'.

            Now considering that I've not used this account in over 6 years (and stopped DMP payments over 4 years ago) I'm a little suspicious as to this letters intent. I'm considering the recent court case where someone with an O/D was found that the creditor had created an unfair relationship by expending the cycle of debt, and there is the class action suit against Mastercard that is potentially kicking off.

            If I cash the cheque am I putting myself in any disadvantage (e.g. not then able to make a claim for something later, not able to claim unfair relationship etc)

                No idea, but I would also be suspicious especially as you stopped payments in July and also received the cheque in July. Will be interesting to hear the views of others as being a worryguts I would expect it to be their way of trying to restart the SB clock

                  I've had ZERO correspondence in 4 years ever since I sent the O/D CCA request to Westcot, and heard nothing since until today.

                  Like you both I'm a little paranoid and my thought was that by cashing the cheque I either by proxy admit liability to the debt, or at the very least encourage them to restart the collections process.

                      Right the cheque is valid for 6 months from its date!
                      In other words you can sit on that cheque!!
                      Do nothing for the moment!

                      That leaves them still outstanding on that s.78

                        Yes and my ultra paranoid self considers they may be able to trace the bank account it was cashed to and use that info in some underhand way (fortunately bank accounts are no connected so no right to offset)

                        s.78 doesn't work for o/d's as such, but admiting other breaches could be a problem for them. As I had over £2.5k of charges added to my o/d in 12 months I think I could successfully argue on the unfair relationship provisions.

                        My thought was that by accepting that cheque I may be accepting that as some sort of compensation which could disadvantage me during a court claim.

                        They've also sent this letter to my old address (received due to redirect), so I'm wondering if its also a possible tracing tactic.

                        Or maybe I'm just giving them too much credit (excuse the pun!)

                          Don't know if this makes a difference to your opinion or not - mum had a refund for the same, but as she still has an account, it went in as a direct credit.

                          I would personally cash it - you still haven't paid money into the account, but that's just me!

                          I cant see it causing issues with SB dates given its a compensatory payment.

                            Agree with last post, my wife also had a credit to her account for errors in interest payments. Nothing sinister Santander cocked up and had to refund.

                                With only 24 months (I think if its from the last DMP payment date), they should be holdoffable, good luck
