          Hi All

          Well looks like BoS have given up on this one.

          Today get a letter stating account has been sold to 1st Credit - "assigned all of its respective rights, title and interest in respect of the above referenced account (including outstanding balance). Under the terms of this assignment and as defined in the Data Protection Act 1998, 1st Credit Limited is not the Data Controller of your Personal Data contained in the records of this account."

          Unfortunately for 1st Credit they have bought a pup as I have a letter from BoS admitting that they cannot find the agreement and hence being UE (though a debt still remains and should be paid blah blah).

          So looks like a Final Response letter will be off in the post to 1st Credit along with copy of the letter from BoS admitting they cannot find the agreement.

            And so the harassment starts from 1st Credit with a text to my mobile number and a telephone call via my employers switchboard. So much for 'removing your telephone numbers from our systems' by the OC and Capquest - obviously it was not.

            I think I will send the same letter I sent to First Source Solutions - it made them back off quickly enough and I'm sure it will have the same effect with 1st Credit.

              Having been through this process a few times now over the last 4 years I have got to love how the harassment ramps up as Christmas approaches as the leeches KNOW that people will have been scrimping and saving just to have some sort of nice family time. They seem to think that we're out buying iPads and sports cars, when the reality was a couple of years ago we had less than £50 which just about covered a turkey and trimmings!

                    It doesn't stop them unfortunately. However they do not have my direct dial so they are calling my employers main reception so they shoot themselves in the foot on a couple of points:

                    1) Their client has been previously told that I am not to be called at work. I have a letter from them stating that my phone number had been removed from their systems and neither they or their agents would contact me at work again - FAIL

                    2) They cannot claim they haven't called me at work - as they go via main reception all calls are recorded - FAIL

                    3) They KNOW they are contacting me at work as they are calling my employers main reception number - therefore they KNOW that by calling me is distracting and potentially detrimental to my employer - FAIL

                    4) All above contrary to OFT guidelines - FAIL

                    So my latest letter to them makes it very clear they contact me at work again, and consequently prevent me from carrying out the duties I am employed to do, that I will be starting legal proceedings against them.

                            I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. I am extremely busy so if you do contact me or need a reply to a forum post then use the email or PM features offered because I do miss things and get tied up for days at a time!

                                Looks like Moorcroft have given up on this one. Received letter today from Lloyds TSB has been sold to Robinson Way. I'll wait until I get their first gem in the post then I'll send them the identical letter I sent to Moorcroft back in May and see what happens!
