              Do you think, based on recent conversations, it's wise to send the new version (link ->) LBA response to these solicitors (it's HC)? Assuming the CCA has been sent, it can't do any harm going a few days later (if at all)....

              Just thinking strategy as this might land on your desk so want to check what you reckon is best action regards solicitor letter (LBA received).

              It's a Howard Cohen threat

                  As suggested in my post above, click the link into the LBA response template. Save it and then edit it (in word / office etc). Add your name & address / reference number and edit the date in the first paragraph. You get this info from their letter to you. Send it to Howard Cohen recorded delivery.

                  Obviously if you've not sent a CCA request to dca - do so at same time but obviously that goes to the dca not the solicitor.

                    Hi everyone,

                    Sorry I've not checked in for a few days, life and all that getting in the way.

                    OK I understand the reason for sending a LBA to Howard Cohen so will do that tomorrow.

                    In the meantime I've received a reply from the DCA, RW. They've returned my letter, envelope and £1 PO and a pre-formatted letter simply stating;
                    1. The account is closed on our files. Please contact the principal directly.
                    2. Please find enclosed.... (my letter etc). Please refer to Tesco.

                      Ok send the request direct to the creditor. Can you clarify, on the LBA threat you received from HC - who shows as their client?

                        The client shows as

                        HPH2 LTD (EX TESCO PERSONAL FINANCE PLC)

                        Must admit I hadn't noticed it was HPH2 and a quick Google reveals that they will have bought the debt from Tesco at some point.

                        So I send the LBA response to them then?

                          The LBA response should go to the Solicitor who has written to you - Howard Cohen. Send it Recorded Delivery First class and keep the receipt

                          You seem a little surprised that HPH2 appear to own the debt.Have you received any form of notice from either Tesco or HPH2 Ltd about them now being the owners of the debt or it being sold? Have HPH2 written to you at all? Maybe prior to Robbo way becoming involved?

                          We need to clarify who owns the debt really.....

                          The CCA request should go to the DCA or whoever is contacting you about the debt for collection. As it would appear that Robbo Way have just closed the account on their books you would need to send it to the Creditor. HC have identified HPH2 as their client so I would send the CCA request to them.

                          As time is a little bit against you now you need to send the CCA request out today/tomorrow - Do it tonight and post first thing tomorrow etc. Don't delay in sending that as it is a key piece of your defence should a claim arrive. Again as with the CCA request, Send it Recorded First Class post and keep the receipt

                          You may obviously need to type out another letter so that dates/addresses are correct - Don't send the original letter - You need this to be right

                            I can't find a letter but do have a vague recollection of one of my debts being assigned a while ago. Maybe over a year ago now. I recall it being a different debt though so I'm very unsure atm.

                            I'll double check my paperwork tonight and see what I can find and also do the letters ready to be sent tomorrow.

                                No Problem, Concentrate on the letters tonight as they are your priority.....No need to turn the house upside down tonight

                                After getting both of those letters done and ready it will be time for a beer

                                When you have time, sort through any correspondence you have for this account and ideally file them all together in date order etc. Should a claim be issued even the smallest scrap of a letter can be of use, Especially anything regarding the transfer of ownership etc
