    Hi there...could anyone help me with the above please? Capital One have now started ringing me (up until 9 o'clock at night). Am not answering obviously!

    Capital One

    My accounts have all been "asleep" for a long time but have recently had some contact from Capquest regarding the Capital One account. I received a letter from them dated 12th March as follows:

    "Thank you for your recent correspondence" (I had not written to them!)

    "Capital One have advised us that they responded to your section 78 dispute on 11th November 2013 with their final response that the Section 78 agreement has been supplied correctly. (I did not receive this if indeed it was sent)

    If your dispute is in regards to another matter, then please can you forward us full details of your dispute so we can forward this to Capital One for their response."

    I ignored this since I had not been in touch with them for a long time.

    I yesterday received a letter from Capquest dated 29th May.

    They state that:

    "As the legal owners of this account we are able to obtain regular updates from the credit reference bureaux regarding your current financial position. We use this data to evaluate what steps should be tkaen to get your account onto a paying status and assist you in repairing your credit file.

    These updates include the following information about you

    1. Bank account balances.
    2.Credit and store card account balances and available credit
    3.Details of unsecured loans and other credit agreements.
    4.Mortgage and secured loan details.

    We will use financial updates from the bureaux in conjunction with other factors in determining our recovery strategy, which may include legal action.

    Alternatively, by working together, we can find a solution that will save your money, improve your credit rating and remove the possibility of legal action being taken. You do not have to pay the full balance immediately; we will work with you to agree an acceptable arrangement. We can offer you a large discount for a one off settlement which will settle this account and update your credit file as part settled.

    We will need you to contact us by 12th June to discuss the opportunities further."

    As you can see from the diary for this account above, Niddy declared this account UE as result of the document Capital One sent me in September 2010.

    I am just wondering how I should respond. (The offer of settling the account is not an option).

    I have only got one of my debts that's actually been sold, but I still send "Account Sold" to any new DCA that emerges from the swamp to have a go. Generally after a few Niddy letters they go back to the swamp and a new one emerges... but hey.
