    Re: Credit Card Dirk Turpins

sorry, but look at your post above, Experto appear to have said they have no agreement, if they have admitted they have no agreement, they can't enforce in a court.................so it looks as if you may have a get out of jail free card?

This is great - basically they cannot and will not enforce this debt, ie they have admitted there is no CCA.

      ----------------------------------------------------------------------

Ok, mehim, what you need to do now is to please list each debt in the format as shown here: ---> Example Diary Layout

However please start a whole new thread here: ---> Start a New Diary by Clicking me!

Then once you've done this I will sort out merging the posts etc to fall into a proper diary - at the moment it's a bit of a mess due to the chat posts within the start of the diary.

For the moment just list the debts themselves then a brief outline of events afterwards, simply click "Edit Post" after you have listed the debts, to add the extra timeline info.

So to begin you'll start a new thread called "mehim's UE Diary" and you'll make one post for each account to look like this:

Originally posted by Never-In-Doubt View Post

      • Date commenced (ideally before Apr 2007)

      • Approx balance

      • Date last paid (approximate date you last made a FULL payment)

      • Are you on arrangement or not paying

      • Status (default/in arrears/up-to-date)

      • Account owner (who is writing to you, a DCA or the lender)
Providing the above information, for each account helps me. Then, when you start the process lay your diary out in a format like this example
All you have to do is read down, you'll see Pixie has placed each account in its own post with updates in colour under each so when she updates these, it is easier for me to spot any changes and advise accordingly.

Yes Experto did say that and haven`t produced the agreement, I assumed they meant that MBNA had it. Wish I had noticed that ages ago. Many thanks evenlessdopey and Niddy

Right thats 3 down hopefully lol.

              Morning everyone.

I keep getting logged out of the site for some reason. Is there something I need to change in settings? to stop this happening.

              Thank you.

                        Re: Credit Card Dirk Turpins

I remember there being other issues with Experto / Varde.

Varde own the debts, but will use Experto to litigate as Varde are offshore.

I distinctly remember a case somewhere, where the Judge threw it out when the defendant brought the ownership of the debt into question and who had the legal right to litigate...

                          Hello thechippy,

I have Experto, CITI, and Claims Management Consultants all batting against me on that one.
They are all over the place on dates, CITI sold it to Experto according to the coms log, before the remedy date on the default notice. Experto then said they were acting on behalf of Varde. Claims Management Consultants say it was escalated to them on behalf of Experto who told me they didn`t know who Claims Management Consultants were.

                          Good fun lol

                              That's easy to understand.

                              They are liars.

                                Hi Cleverclogs,

yes they sure are liars. It amazes me the way these companies seem to be allowed to ride roughshod over the law. One does wonder what the members of parliament actually do for a living.

The above has the deliberate mistake in it, that should be reading

the agreement was enforceable if they hadn`t seen it.
