    You were PM'd with good advice!

    Reading through that thread OTR, with the exception of a couple of posts, many of the responses are questionable.

    You should never respond to a fishing letter, not with a 'prove it' letter, CCA request, SAR, SB letter or similar.

    Ruthbridge have given you no reason to respond with any of these things. Before you even bother with the effort of the time and the cost of postage they need to provide the following:

    1) Reason for contact
    2) Details of an account
    3) Details of an outstanding balance

    When they finally send you a letter with something tangible you can respond accordingly but not before!

    Don't worry. My wife passed away a couple of years ago, and I also suffer depressive episodes, so I understand your concerns. I have a lot of debt written off because of those little cheeky monkeys in the so called "industry" of Financial Services not being clever enough to have the right paperwork!

    Listen to Niddy and the rest of the good advice on here.

    Today, I got a letter from some clown at Westcott. I actually got excited, as I've never pissed those particular thieves off, so looking forward to it!.

    Well done m8 you have found the right place and good olé niddy has replied so you are now in good hands.

    I will not offer advice myself as you are already getting it from the good folk who have posted above, however I say again do not get stressed over this as it is just not worth it you life is far more important.

    You have found a good crowd of people who have all been through the same and many of those are seeing results.

    I was taken to court after MBNA turned down my offer of £50 and was told to pay £20 a mth on a 6.5k debt by the judge and this came with no terms to increase so what I am saying is it's early days with much to gain with the right advice.

    Hi Mike & Welcome

    As the guys above have stated, don't stress - if they get clever with you we'll kick their arses and get them sorted. Thing is, whatever you do don't respond to them - await further correspondence and then post here with details before doing anything.

    If for whatever reason they get your new number then similarly, just hang up - do not get drawn into dialogue with them. These guys are clowns and nothing to be scared of so don't be.

    Best of luck, and chill out yea? Debt cannot hurt you in any way or form.

    Your not on your own with this any more you have found the right place for help just sit tight and you will be ok ,we though the world was coming to an end before AAD and I also suffer from a depressive ilness as well as many other things and I have found AAD to be a tonic at times just knowing there are other people willing to help

    But as you have that letter from MBNA then thats your trump card at the moment. You shouldn't even need to CCA again as this is if the original creditor doesn't have one chances are any DCA aren't going to unearth one either!

    You're in a strong position right now so you can relax a bit.

    Hey mike, its not a case of allowing you on board, all those genuinely in need are welcome here and we have more senior mods than me who are experts in weeding those that aren't. A number of our members have depressive illnesses. We don't judge anyone here. Our aim in life is to help and support others who are in trouble. Most of us have been or are where you are now and some stories are horrible. However you are now here, you can look anywhere you like on this forum and you will note that abuse of other members is not tolerated, unlike many other forums.

    However from the information you have suplied so far it would seem that you already have a letter from MBNA saying that there is no agreement. Well thats real tough as Ruthbridge can do nothing until such times as one is found. The account is UE, end of until the unlikely event one is found. We have a series of template letters and also "Niddy specials" (Niddy as he is known is never-in-doubt the owner of the site and expert in this stuff). Finally if things get really rough we have a site preferred solicitor who we can refer your case to who is full blown specialist in this field.

    If it was me at the moment I would sit tight, it seems to me you have all the aces at the moment. You have seen off the other crowd, this just another bunch of the same. I know and understand it is distressing for you but you are now in good hands. But each time they put a foot wrong, we put them down by arming you with the tools to do it.

    Sleep a little easier tonight.

    Hi MikeB

    The letter you have mentioned is a standard 'fishing' letter and is worded in such a way to make you 'bite'.

    As Garlok has already mentioned do not call them on the telephone.

    The reason they have sent you this letter is that they more than likely will have no more information than:

    1) An account number and balance
    2) An address

    If you contact them by telephone, unless you withold your number, they will instantly have this and record it. They will also try to convince you they need a telephone number for 'security'.

    What they mean by this is you then give them the means to phone you constantly and subject you to harrassment.

    Ultimately there is no compulsion to respond to this letter, there is nothing to state why you should, and you could easily argue that as there was no credible reason stated to require you to call them you thought it was nothing more than a scam.

    Until they write to you with something more substantial I wouldn't let it worry you.

    Do you still have the letter from MBNA stating that they do not have a CCA?

    If so then if it is for this account, and if the morons from Ruthbridge bother to follow this up, then you can send them a letter stating that you are still waiting for compliance from your CCA request, that MBNA have admitted to not having a CCA and to go forth and multiply!

    You are a loooooong looooooong loooooong way from bankruptsy/charging orders and all that gumph even if things were to ever get to that stage.

    As MBNA have admitted they don't have a CCA its likely these losers have bought the debt for next to nothing and are chancing their arm.

    Important thing here, is that this is a bit like playing 'chicken' and you don't want them to make you blink. The ball is still very much in their court so let them play their hand and make the next move.

    Once/if they do you can take things from there.
