              it now seems the account that has been passed to capquest (kays) have now sent a 'proof of debt' to iva company even though this was not included in the iva, i am yet to hear off capquest myself???

                          No, you'd forgot to tell us the most important thing of all. You realise whatever we've done to date is for nothing?

                          Speak to the IVA company and ensure EVERY account you have is with them, you know if you deliberately withheld this account from them then it's *illegal*?

                          I'm confused somewhat - obviously!!!!

                          * Illegal in the sense that IVA is formal and one short of BR thus you must declare all accounts as it breaches and invalidates things if you have any credit accounts without the insolvency channel authorising it.....

                            Spoke to them today and even though the account is in my name it is a family member that has ordered not me so all is ok.

                              but its not, you have credit in your name whilst on a formal IVA.

                              I strongly suggest you consider your position as you're playing a very risky game, and as I know you're on an IVA I cannot offer any further advice regards these accounts as I am always going to have to retort to "speak to your IVA handlers".......

                              Sorry but that piece of information changes everything

                              Question, why didn't you add these two accounts to the IVA, are there more?

                                Re: kays / very - ndr debt CRA

                                Have a mooch here at one such example....

                                ---> IVA Explained, FAQs

                                Will I still be able to obtain credit?
                                The IVA proposal normally states that you can only get credit if your Supervisor allows you to do so. This does not normally apply to individuals in business who can demonstrate that they need credit to be able to continue trading.
                                Clearly, I guess if they are saying it is fine then it is fine however my concern is you're falling into debt with these yet you're saying it aint your debt anyway.....

                                Why can't/didn't you add them to the IVA? Something just doesn't add up here.
