Re: Why I have come to your site.

Just had my SAR's request from Santander returned, stating they can't find account, and to resubmit with account details??????
Strange, as i do have a loan with them for my car which is all up to date.
    What are they playing at????

Re: Why I have come to your site.

A SAR is not account specific, but person specific!

Me thinks they made a wee mistake somewhere...... I guess you've not moved or anything have you? If not then you need to send again with a strong cover letter saying sort it out muppets!!

Re: Why I have come to your site.

              UPDATE.

              1. Santander SAR request - sent a strong letter attached to SAR (2nd Letter).
Response - Quote - You have asked for copies of you bank statements, which we assume is to enable you to reconcile your bank charges.
Goes on to say they cannot locate my records with my address and to provide them with acc numbers and date of birth. Very strange when i have a car loan with them for this address!!!!!!!

              2. Santander Default - I did send them a default removal letter and they have responded. However there are some glaring mistakes in the letter.
              a. they thank me for my letter dated the 19th July 2011 - which is 2 months out????
              b. also they say in the letter that the joint acc was taken out in both our names in september 1990 - this is also false as i never married her until 1997, the account was hers and i was an additional holder from about 2000!!!!

              3. Lloyds SAR response - They cannot find my details with my current address and request i supply all the details of accounts etc and other addresses. Strange how i received a letter at my address from Lowells and LLoyds in the same envelope.
Also they have requested i send a signed letter they next time i write.

Any help on the next step would be helpful please.

              Regards

Re: Why I have come to your site.

Never sign anything no matter that they ask for. There is no requirement for you to sign. Send this letter to them Demand of signature by creditor

Always print your name e.g. J BLOGGS that is all they need. They will try and say it is data protection etc but then you have to ask yourself how they managed to send other sensitive data to you - did the DPA not concern them then??

They have been known to Photoshop your signature and use it on documents so ignore their requests

Thanks, would not send my signature.
Does anyone have any advice on how to proceed with Lloyd and Santander?

Politely ask them to stop playing at Silly Buggers or, in Santander's case, Insectores Tonto.

Re: Why I have come to your site.

                      Another Update.

Lloyds - Letter No3 - Sent a strong letter asking for the Advanced SAR again, pointing out they don't require my signature as per the template.

Santander - Letter No3 - Advanced SAR request - Another strong letter sent.

Santander Default - Letter requesting default information, and pointing them to the incorrect statements within their letter.

Lowell / Lloyds - Just had a letter from Lowells asking to contact them for payment the following way:
                      1. Pay 75% of the balance as full final settlement.
                      2. Pay 85% in 3 equal payments.
                      3. Or agree a payment plan of £60 per month.

I have not replied to lowell as waiting for the SAR from Lloyds.
What should I do about Lowell at the moment? Anyone else had similar letters?

                      Regards

Ok, few issues to consider, so please start off here by doing me a favour and do not send anything else to anyone; do not speak to anyone on the phone and most definitely do not pay anyone for any of these debts right now.

                        We need to ascertain
                        1. Liability
                        2. Balance
                        3. Status
                        4. History
Then we'll be able to help; so ideally you need to be sending an advanced SAR to both Lloyds for the loan and Santander for the bank account, however note a SAR is person specific and not account so if you have other accounts you'll get a whole host of shyte through the door i'm afraid. You then filter through all the info and then update this thread with the following info:

                        Lloyds
                        • What is this account?
                        • When did it commence
                        • When ddid it default
                        • When did you last pay
                        • What is the balance, as claimed
                        • Was there any PPi etc added to it
                        Santander
                        • What type of account is this?
                        • When did you last have anything to do with it?
                        • Did you notify them, in writing, of your intention to close it before the ex took ownership?
                        • What are they claiming is owed?
                        • When was the account last used (by either of you)
The Advanced SAR will not acknowledge the debts however it'll allow you to get these answers for me.

Until then - chill and ignore them, stop sending letters and most definitely stop talking and paying them!

                        * Ps statute barred is 5 years in Scotland, in your case if you took it out in England and paid fine, then moved to Scotland and then fell into arrears the 5yr rule would take effect as at the time you fell into difficulties and stopped paying, you would have been living in Scotland. If you lived in England and then stopped paying, it'd be 6yrs regardless where you live now.

                        Make sense?

Advanced SAR Template here: ---> Unenforceability Templates - Section 3

                        Best of luck
I asked you to provide this info a while ago so we can properly help - the reason responses are slow is because we cannot best help if we do not know what it is we're trying to help with!

Re: Why I have come to your site.

Sorry for the delay in the update, been out the country for a while.

LLOYDS: Unsure as to what this is for - Advanced SAR sent after several attempts and awaiting the results.
As soon as the info arrives i will update with all the info required.
However -Lowell are now saying if they have no response, the will pass on to their collections department. Should i send them a letter while i wait on Lloyds?

                          SANTANDER: Santander
What type of account is this? This was a Current Account
When did you last have anything to do with it? I never used this account. However the mortgage was paid from it which i used to deposit money in to pay for it. The last time I deposited any money was August 2009.
Did you notify them, in writing, of your intention to close it before the ex took ownership? Unfortunately not as as i trusted my wife, I Know 'bloody Idiot'.
What are they claiming is owed? £1500
When was the account last used (by either of you) Awaiting the information from the Advanced SAR, the default was registered January 2011 though, and my wife had changed the address to her new address when the house was sold.
Received a letter from Santander, after I requested the default information with £1 standing order. This was returned asking me to fill out a form with my new address. I have not done this as i believe this may make me liable. What to do next???

                          Regards
