      I give up! best of luck. You're not helping us to help you so sorry, I don't have the time to piss around like this. Have you read anything posted above? ONLY a HCEO can break into COMMERCIAL properties. So you're now saying it's your home, well that is bollocks cos unless you defaulted on a CCJ they would not have the right to do this and even then, only through an open window or door. They cannot break in!

      You need to start being open with us or I will just close this thread as you're holding so much back, or taking the piss (ie being a troll) - sorry but that is how it appears to me. Love for you to prove me wrong - but right now considering the urgency of this, you really don't seem to give a shit which is what makes me think this aint real at all.

        Please accept my apologies If I have upset or confused you or anybody else,. This is not my intention. I am honestly bieng totally open, have not been in this situation before. The money I owe is from business premises which I vacated on 31 July. I hope this clarifys my position.

          Can you not start at the beginning and just pretend for one moment that we don't know what you're on about and pretend to tell us a story about a man that met some dodgy bailiffs due to business premises.... lets hear this story and then we may well be able to offer some help.

          Right now you've told us three things;
          1. Its an old business related debt
          2. HCEO's are involved
          3. You're in Oxford
          So using your own intellect here, tell me, from that what would you advise? Its not hard is it? Nooo, surely not?

          Now you must appreciate why i'm asking for more info in the most polite, albeit sarcastic, manner possible. To be blunt just tell us the whole story please mate or forget it - your choice?

              The premises for this outfit is in Croydon, not Purley. I know the building that they are using very well, as I used to drive past it to on my way to work every day, once upon a time:

                Having read and re-read this thread (because it is quite difficult to follow to be honest) the only point that stands out to me is that you state that you took out a business lease in your personal name. Is it therefore possible that because it was taken out in a "personal name" rather than in a "business name" that he is personally liable for the debt incurred?

                Could this be the reason why the bailiffs have been sent to his home?

                I have no experience and can add no advice, I just wanted to mention something that stood out to me.

                  I like jigsaws, so rejigging the posts into some sort of more easily understandable order, I think this is what happened

                  In Sept 1998 I took business lease on a property in Oxfordshire in my personal name.
                  In 2000 the business became ltd co but I did not transfer the lease to the Ltd Company.
                  In April 2010 I closed down the Ltd Company

                  My son & daughter started new co in same premises but again the lease was not transfered to their company (I was not a director or employee, and only helped in advisory capacity).
                  The landlord was aware that I had sublet to my son and daughter, but there was no formal arrangement regarding this and no formal arrangement for my son to pay me rent.

                  Their Company struggled and could not pay me the rent, I was not earning so could not pay the landlord for the end of 2010 and this year.
                  The landord took me to court for a possession order in June (which I did not contest as I had not received any notification of proceedings) and son & daughter moved out 31/7/11 as requested.

                  I received a letter dated 03/08/11 (incorrectly addressed) and Order for Possession from landlord.
                  I replied 08/08/11 stating could not pay in full. I have other debts and enclosed a repayment schedule with advice from debt advisor.

                  Last Wednesday 2 High Court Enforcement Officers came to my house, while I was talking to one, the second man pushed open the front door (which was closed but not locked) and walked in without my permission. He logged items to be removed and gave me until Monday 5/9/2011 to reach agreement.
                  I was under pressure and foolishly I signed a document where he had listed a number of household items.
                  I emailed them and the landlords solicitor stating my desire and commitment to pay and stating my financial position.
                  They are due to return tomorrow unless I reach agreement withn the Landlord. I submitted my offer Thursday evening but have not had a reply or aknowledgement of my email.



                  I have not received an original claim for notice of judgement, neither have I received a S.21 notice

                  I live in rented accomodation and am not earning(?). I admit that I owe the debt and want to repay it but will not be able to if my possessions are taken


                  Please advise

                      This does not add up. The timeframes are all wrong. I am sorry william, BUT I was away over the weekend and like I2D has said I believe these people are not quite who they say they are. We have recently had faxes to our business from outfits purporting to be court officers when they are nothing but chancers on the DCA circus.

                      We know nothing of the size of this debt or any detail of the actions taken against you at what level and in what court. I feel Niddy is correct here, you either need help and support which will be freely given (and already has on a Sunday!) or you are attempting to give us all the run around.

                      We do have preferred solicitors to whom we can refer you (proper officers of the court) should you be genuine.

                          And what advice did the solicitor give you today broadly speaking? We aim to share our experiences on this website so as to help others in similar situations. Did the bailliffs/sherriffs return today Yes or No?

                            You'll have more luck pulling dracula's teeth than getting anything constructive from this poster.....
