    I am pretty sure its enforcable, its got all terms and conditions including APR and a copy of my signature and date. But happy to upload? Its about 10 pages and as I have no scanner, I would need to make .jpg files and upload them? Would that be ok?

    Received my CCA today including a photo copy of my signature (which is mine) from Capital one today so looks like its enforcable It has a copy of the so called original agreement and also a copy of a reconstituted agreement and a cover letter stating that this is sufficient.

    The letter also states that my account is in default (they even provided me with the default date) and I should continue making payments.

    Not sure what is going to happen from here, I am hoping my £300 a month (whcih I can increase to £400 from July 2012 onwards) will be sufficient and they won't try for a CCJ seeing at £300 a month this debt will be paid in 18 months.

    Shall now sit back and wait what CFS and C1 come up with next

    yup just wait and see what they come up with, which will probably be nothing and it'll be sold on again.

    Good Morning Hope everyone had a nice christmas. Quick update, received a letter from C1 today from the head of executive response centre.

    "Thank you for writing to us about your account. Its going to take us a little while to to look into your situation and come back to you with a detailed response. We'll do everything we can to get an answer to you within 7 weeks of this letter.

    If for some reason our investigation will take longer than 7 weeks, we'll contact you to tell you why this is.

    Thank you very much for being patient while we collect the information we need."

    I shall sit back and wait now seeing that CFS placed the account on hold for 30 days and C1 wants up to 7 weeks

    Just wait and see, if you're unsure on anything then give them a call - after all you're paying £300 per month!

    Thanks Garlok. I was just wondering what it meant that CFS are putting teh acount in dispute with C1 over my payment plan?

    But yes, will sit tight and ignore C1's and CFS's letter but it would now explain why they want my signature again

    The moment you make any form of s78 request or SAR then most financial institutions go into defensive "complaint" mode. They know a significant proportion of their documents and processes are defective and probably unlawful and it is a way of holding you at arms length for a bit longer. (And of course extending the grief they can give you)

    Sit and wait now, the ball is firmly in their court would be my approach now
