    Fredrickson eventually responded to the letter last week saying the account is on hold whilst they contact their client for further instructions.

    On the 8th I received a letter from them asking me to please call them to discuss the account, no chance of this happening!

    Just ignore and wait and see what they come back with next

        Its been quiet on the Fredrickson front until today, received a letter from Bryan Carter Solicitors demanding payment in full within 14 days or they will recommend to their client...Capital One that proceedings will be issued, the costs will increase by surprise surprise £837, the exact same amount that Fredrickson stated.

        They then go on to state if I dispute the claim please provide documents in support of my defence to any claim. I can avoid all this by ringing...you guessed it, Fredrickson!!!

        Do I send the threat of legal action letter to these people(I'm being polite here!!) as well, along with a copy of the fredrickson... going back to our client for further instructions letter I received on the 2nd August

          yea, just do as you quote above, send a double letter (same envelope) and see if that registers in their thick skulls....

              Its been a while, after fending off DCA's with no correspondence, I received a letter last week informing me that Capital 1 have taken back ownership of the account. Nice of them to let me know!

              Fantastic new site Niddy, very impressive.

                I had a similar experience so if your case follows the likely same path, expect some calls from another DCA as they pass it down the food chain!
                Some days you're the pigeon, some days you're the statue. I currently spend too many days as the statue......but thanks to this site not as many as I used to!

                  Hi Guys

                  I know its been a while in me posting, but I have been keeping up to date with the site and reading as much info as I can. I have another problem that has reared up and that concerns a Bank Of Scotland card that has not been chased by anyone for a while and then Moorcroft have decided to give it a go.

                  The balance is £6253 and I have not paid it since 2010

                  I have a letter from BOS stating that they cannot find the "True Copy" I requested back in January 2011, which I have kept safe. I have had a couple of DCA's try to collect but when I sent them a copy of the letter received from BOS and a copy of the general unenforceable letter they soon ran away.

                  Now onto Moorcroft, they contacted me in June with the usual threats, which I responded to with a copy of the BOS letter & unenforceable letter, their initial response was to put the chasing on hold whilst they "contact their client".
                  They then came back to me saying "their client has sent me all the "relevant documents" And they still want their money paid. I had 14 days in which to reply, to which, I replied to within three days, sending once again the copy of the letter stating they did not have a "true copy" and politely asking them "to read my previous correspondence to them".

                  I then received a letter 7 days into the 14 days they had allowed me to contact them saying that because I had not been in touch they would be arranging a door stop visit. Again I sent the same correspondence along with a "threat of a doorstop visit. That was 10 days ago.

                  Today I received another letter, thanking me for my recent correspondence in relation to the account, "that they would like to confirm that BOS have sent all the relevant information and even if the balance is unenforceable it remains correct and is due for payment" Then the usual threat to make contact and discuss a repayment schedule I can maintain to avoid any further action being taken.

                  The last bit makes me laugh though..." However if I am unhappy with the information provided please contact them by return"!!!

                  Now my question, which letter do I need to send to "these people" in order for them to understand that it is unenforceable and NOT due for payment!!!

                  Any help would be, as usual greatly appreciated.

                    So thats the letter you need right?

                    Moorcroft are correctly stating the position, which is the debt is UE, however this does not prevent them from 'carrying out collection activity'.

                    Its a similar principle that they can record the status of the account to the credit reference agencies.

                    As you've stated, they're going to get diddly squat from you. They'll keep sending letters until you draw a line in the sand. I think theres a final response letter in the templates section which you can send, and then thats it.

                    They'll eventually get bored and go off to bully someone else.

                        Wow Guys that was quick! Thanks for clarifying it SnV.

                        I have always replied to each letter I have received from "these type of idiots" as I follow the principle of a good paper trail. That way, when they try and accuse me of not contacting them I can refer them to my previous correspondence with recorded delivery receipts.

                        Having said that I always wait a few days just in case I get another letter that contradicts the previous one from them!

                          Time to leave this and let it go SB to be fair, especially as they do not have the agreement

                              I followed Niddy's advice and ignored the last correspondence and have heard nothing until yesterday when I receievd a letter from BOS telling me they have transfered my account to Iqor debt collectors and instructed them to collect the outstanding amount.

                              My question is, do I wait until I get a letter from Iqor asking for the money or put in a pre-emptive stike and send a copy of the BOS letter saying they have no agreement and an UE letter that I have previously sent to Moorcroft?

                              I am only asking this as this is the first time I have received a letter from BOS telling me they have transferred it to a debt collecting agency.
