      As usual daughter is too laid back over this, says she has nothing they can take, so nothing to worry about. She has now "found" a few letters that she should have given to me. Letter dated 21/03/16 from Robinson Way regarding CCA request for credit card from Santander. Following your request, we have today asked for a copy of the agreement / statement to verify that you are liable to pay the amount due.
      Your account has been placed on hold temporarily pending receipt of this documentation and we will contact you again in due course.

        Next letter 11/04/16. Robinson Way Due to Santander Bank. Tells me that they are acting as agents only. Amount due over £8500. Help available Balance Reduction Offer.
        This is simply a letter trying to get her to call them.
        Daughter tells me that many years ago and 9 house moves ago, she took out a loan to buy a car, she also remembers that she was told that she had to take out insurance, ie PPI. since then, every time that she got in the S--t they gave her a new loan,4 times, until in 2010 they refused to increase the loan. Last token payment was £10 on 30th May 2011.

            Today received a reply from Robinson Way regarding CCA request for Santander credit card.
            Due to HPH2 LTD (EX SANTANDER UK PLC)
            Further to your request for a copy agreement for the above account, please find enclosed the relevant documents for your attention.
            Please note if an original credit agreement was not available, under the consumer credit act a reconstituted copy may be provided.
            Please contact us with your proposals for the payment of your account within 10 days.

            They have sent a totally illegible copy of the agreement, signed by daughter on 25 06 2008, not signed on behalf of Abbey. I tried to read it, wife & Son have tried, even using a magnifying glass, impossible to read. What do members suggest as next move? 11 months to SB.

              I would be tempted to send the illegible documents letter from the AAD+ letter templates, but wait a couple of weeks to drag out the time.

                  Latest reply regarding overdrawn bank account, sent CCA for overdraft letter. Due to HPH2 Ltd (Ex Santander uk PLC) Letter from Robinson Way
                  We write in relation to your recent correspondence, the contents of which have been noted.
                  Please note that this balance relates to a bank account and as such is exempt from part V of the consumer credit act 1974. There is therefore no requirement to produce a copy agreement. However, we can confirm that this relates to a Santander bank account ----- which was opened April 2002 and defaulted 31st January 2012.
                  We can confirm that we have requested a copy of the statement for the above account to show how the balance accrued. Your account will remain on a temporary hold whilst we have received a response from our client.

                  Last payment was sent May 2010. Took over 21 months to issue a default notice. Suspect that they just continued building up an overdraft by paying to either loan, or credit card account. Should I now send a SAR?

                    They can delay it until the anniversary and then cancel / request repayment but then again they can also leave it running indefinitely if you did not default (ie if you had a £1k limit and was only £10 OD there'd be no need to default you)....

                    You'd need to be more specific about the OD and whether the default arose due to charges / exceeding the OD limit as that would affect the default, regardless when they actually did send a DN.....

                      Thanks for the reply. Don't know the answer, daughter has moved house 5 times in the last 5 years, no paperwork, as she shredded everything. Will wait for Robinson Way to send a copy statement to show how the balance accrued, hopefully this should explain it.

                      Or, should I get her to send a SAR now?

                        I'd request SAR yes, Santander is who you send it to.

                          Cheque cashed for SAR 5th August, still waiting for info. Had good news regarding outstanding electric bill from many houses ago, Npower have written off the balance after lots of letters and phone calls.

                              Still no reply to SAR request, do they have 40 working days or is this now overdue?
                              Regarding illegible CCA received, they are still waiting for information. CCA request regarding overdraft, Please note we have not yet received a response from the original creditor. Everything in limbo at present! Good news.

                                SAR is 40 days from receipt. It's rare it's ever on time - just sit tight a few more weeks.
