    Okay, thanks very much - wasn't intending to come across as obtuse (or, eh, a bit slow on the uptake) just didn't know whether to make any mention at all on the new one. A fresh one, with no mention it is, will shut up now. Thanks again for your help.

      It'll only confuse poor Brian if you mention anything complicated. Be kind to him and just send a new CCA request, he's used to those

          Just remember, even if Barclaycard do not have an enforceable CCA. They will always "consider" that it is enforceable.
          Barclaycard & Barclays Bank are in the Sh-te! they are broke. They are, just like us, fighting to keep their head above water. Do not believe anything that they send. Treat it as UE.

            Thanks Enforcer. Yeah, they have always insisted it is enforceable and said that all they have to send are the terms. I didn't realise though that they might be apt to be a bit more aggressive then, given their situation.

            Will treat as unenforceable, and won't do anything on the account without checking here first.

            Initially, thanks to Niddy's help on another forum, a couple of creditors actually admitted accounts were unenforceable and said they wouldn't pursue. But that definitely doesn't seem to be Barclay's way. Thank you.

                    I have had the same problem, trying to get a compliant CCA request from Barclaycard for over two and a half years. They have only sent terms and conditions previously. They then refused in writing several times to comply with CCA request. Their last attempt was to send copies of terms and conditions at inception, however these were sent, together with cancellation notice, by post at a later date. Copy of current terms, and an unsigned statement of account. They insisted that this complied with regulations. Now in the hands of Ombudsman. I want a reconstituted copy of my "Executed" agreement. Not "signed and or properly executed as they stated. I also want a copy of the "prescribed terms" that they state, "would" have been on the reverse.

                    As the application form, which becomes the agreement, is NOT signed by Barclaycard, it will be interesting to see what happens now that it is in the hands of FOS.

                    Keep on at them!

                      Thanks, Enforcer. I will be really interested to see what happens in your case, hope FOS means you will find out what they actually have (if anything). I thought the whole point of these requests was they had to provide a 'true' copy of what they have. I realise they won't make it easy, but it seems like they could send a blank sheet of paper and just say 'it complied',

                      Carter have come back returning my payment and saying to contact Lowell. Except, I had already been in touch with them when they bought it saying it was in dispute to which they just said Barclaycard said they had complied!

                      So, I think back to Lowell with a fresh CCA request.

                      Yeah, they just seem to send whatever they want and say it complies and then insist they have fulfilled the request (even if it doesn't have any of your information on it at all).

                        I just wanted to update on this and say thank you very much. I just received a letter advising, finally, that they didn't have the documentation and would be closing the account, unless/until they find it. Thank you very, very much!

                              Congratulations tryingto. In my case FOS asked for copy CCA & terms and conditions at the time I signed. Barclaycard could NOT comply with FOS adjudication. Took me a long time to get there though.
