    hi all again thank you so much for all your help

    It looks like it doesnt matter that the agreement wasnt signed on behalf of the credit company, the court will most likely allow enforcement. It also looks like ill have to return the car :/

    ill pop on an update once ive been to court tomorrow.

      Have you spoken to Paul? Did you send him any paperwork...?

          Hiya

          Don't beat yourself up about it. Basically, as Paul no doubt said, you'd be best taking some forms with you and going for a time order. To do this you need to print 3 copies of each of the attached and take them with you to court (obviously as you cannot copy stuff you'll have to complete the N440 3 times - unless you can complete 1 and then go to the corner shop to copy it?).

          So long as you can afford the N440 fee and can offer some form of repayment then a time order is no doubt best for you - i.e. stops them taking the car as you renegotiate the terms of the original agreement and you'll be hoping the court agrees and allows you time to pay (+ the arrears)...

          So, the basis of what you'll be arguing is the Consumer Credit Act and in particular sections 129 & 135. Both these sections are also attached as a pdf for you, so you can easily print 3 off.

          Read both those sections and then try and complete the N440 and see how you get on. Are you able to print these, pay the fee, arrange some form of offer/repayment (N440) and hold your own in court tomorrow..? If so then great, I think you'll be fine.

          If not, then shit - lets re-evaluate things.

          Whatever you do try and not stress yourself out too much. It's happened now so nothing we can do about that, shit does happen - don't feel bad, if there is a way to beat this then we will help you all the way - but sadly due to time constraints we're limited in what we can do as we cannot even get paperwork at this late stage (ie agreement/default notice etc)...

          Please try and relax, grab a beer/glass of something and try and compose your thoughts and get that fighting spirit back - it's your car, not theirs so fight for it

                        Hi im ready to go just sat here waiting. ive just discovered two mistakes in their witness statement though one being the amount offered. and the other is they state my last payment was 10.12.2013 -- seems they cant get any paperwork correct!

                          I got as far as "print 3 copies" and just gave up Niddy i dont have a printer and we are here on our own, family all in scotland so i couldnt even ask someone to print them. im so sorry im at breaking point x

                              Lots of us have been to court for debt, it really isnt that bad when you get before a judge, they will listen and take things into account try and remember what niddy has told you and best of luck.
