I made a s78 request to MBNA in 2009 & received a copy (reconstructed?) of an alleged agreement. Niddy says this is unenforceable although I am not sure on what grounds.

DLC have been sending further copies of this saying it is a copy of the agreement and is 'fully compliant'. This has been going on for over 18 months!

Ok so they're messing about. Why not stop. Start at basics as its now 2012.

Send one cca (recorded delivery) to the dca that owns the account. That's it.

Do that first please. The version you sent me was ue as the PT's are not from the a actual signed agreement but let's clarify that with a whole new request.

Response to CCA request now received. Should I send this through to Niddy?

            Thanks

Sorry - just checked & its about 10 megs. I increasesd the quality of the scan over the usual 300 dpi & forgot to check the .pdf file size. Thought it took a long time to send!

                    Apologies

                      Re: DCA Evasiveness

I totally agree that they will not answer request under CPUTR. However S78 will work!

Letter today re Lloyds Card. mackenziehall, Having referred this matter to Lloyds, they have confirmed there is no copy of Credit Agreement available; however you would remain liable for this debt albeit no legal action can be taken. I can confirm statements have been recently sent to you which show how the balance was calculated.
The "Hold" status will remain on your account for 30 days, to allow you the opportunity to contact us to discuss this matter further. If we don't hear from you within this period the "Hold" status will be removed and normal collection activity shall resume. I would therefore ask that you contact our office on 01563 554540 to speak to one of our advisors.

No chance of me speaking to them, made that mistake in the past! However during the course of the next 30 days, I will most certainly worry myself sick about how I am going to pay them nothing!
Must think we are daft! Not on this site. So much advice from members.

Excellent, keep that very safe and frame it - you win! If they now try and resell it you copy that letter and highlight that part (the quote above) and forward it with this --> Our Templates | Unenforceability Templates | CCA Query - Letter Previously Confirming No CCA
